Are you an American citizen living in Baja with an FM3? If so, it is illegal to sell your car. Matter of fact, just placing a "for sale" sign on it would be grounds for confiscation.

Dave's right - regardless what type of visa you have - it's illegal and you run the risk of losing it for even dicussing the deal (yeah I know - people still get away with it).

Follow Tucker and Dave's advice - the smog test is irrelevant - work out a cash deal in the US - all you need is the title, which doesn't have to be in your name - he can still work out the importation without title but it'll cost him a little more.

Thanks for the feedback, good to know.
I'll sell it to him in the US then.

Here's what our experience was with this issue...

Just south of Mulege, our community on the Bahia Concepcion, sold a licenced Oregon 1994 Toyota, one of the beach residends had, to our night watchman. He took it to Loreto for "importation" and came back the same day with a sticker for his back window and a title...cost at about $90USD. Done deal...He says you can't just import something new...defined as less than 5 years old.

Casa Manzana is correct.

You need to import it before it can be sold legally. This can range anywhere between $90.00 ( the lowest quote I've heard) and $800.00 which is the highest I've heard.
If you let the person buying it deal with the legalities, it will cost less for both parties.
