Onscreen instructions on the Loreto Bancomer ATMs say that in the event your card is not returned, call your bank. They don't say anything about
contacting Bancomer.
Perhaps the employees shred the cards, not the machine.

I have had them keep mine twice at the bank they wont return them

It's NOT illegal!
Any vendor can hold and destroy your card if directed by the card service company. Normally this is in the form of a message or code displayed on the
card swipe machine.
Banks that service their own ATM's have a written contract with the card service company that directs them to destroy cards held by the ATM machine.
Both banks and vendors are allowed some leeway. If a customer requests it, they can contact the card issuer (not the card service company) and verify
it's status and then either return or destroy it. But the ATM machines aren't equipped with shredders and can't destroy cards.
I had one of mine destroyed by a restaurant when my card numbers were stolen from the card service company by hackers. Since I'm a full-time RV'er,
the notice from the card company telling me that the card should be destroyed and that they were sending me a new one hadn't caught up with me yet.
Somewhat embarrassing.

Mr. Toad don't forget that this forum is about Baja which is in Mexico. when you cross the border all of your US rules and regulations go out the
window. the card companies here in Mexico make there own rules. and they are
sometimes a Little vague so banks can vary there polices quit a bit.

Too true. But I'll bet that banks or vendors destroying cards isn't illegal in Mexico either.

when we get a message on our machine that says keep the card we are supposed to destroy it and call the bank or police if the customer puts up a fuss
about it. we don't usually do this though we usually give the card back and tell the person to call there bank. unless the card is obviously stolen.
most of these rules are set up to protect the consumer. here in Mexico as in the US we have a problam with credit card theft.

i cut up cards ALL the time and haven't been arested by the "plastic" police....YET
it's much safer for the customer if the lost card is destroyed immediately...
and...
it's FUN to chop up those cards

I haven't had to destroy any cards. I first check the Id's of the peple and if they don't have sufficient ID to prove they are the card holder then I
don't run the card.
