Advice on how to sell a lot in Rosarito Beach
Hi Nomads,
I am trying to help a widow friend of mine whose husband passed away this year. He (deceased) owns a lot in Rosarito Beach with 2 other people. The
wife wants to sell the lot. From the paperwork she has it seems that the Annual Fee for the bank (Fideicomiso HSBC bank) has not been paid in several
years and the property taxes have probably not been paid either.
Questions -
1. What is the best way to start the process to sell the property?
2. Does anyone know a reputable real estate Agent in Rosarito?
3. How does one find out what the back taxes are? Where do you go to find out this information?
4. Does the land pass to the widow?
5. The other 2 owners are not proactive and are leaving everything up to the widow. If the lot does sell how do all the owners sign the necessary
paperwork? Is a Power of Attorney in the U.S. respected in Mexico?
6. How does one get the land appraised?
Please U2U me with any answers. Any help from Nomads is appreciated.

I suggest you contact a competent/experienced real estate attorney or Notario. That way you will get correct/legal answers to your questions

What are the chances someone claiming to be rosarito lawyer is competent and has ever done a probate for a foreigner?

1. Find a buyer and then the rightful owner (the person or persons) of the property can go with the buyer to a Notario.
2. Angel Saad Notario #4 in Ensenada
3. The back taxes can be determined at the municiple building in either TJ or Ensenada. Fideo fees probably at the bank. This is also info that the
notario will get for you.
4. The land passes to the beneficiary named on the fideo papers
5. Again the notario can answer this one, but in my experience the power of attorney was filled out and signed in Mex.
6. That is also something the notario will take care of.

One last nasty step;
when and if you ever get monetarily compensated for the share of the property in US dollars, the IRS will want their share too of the capital gains of
the estate.
