Purchasing or selling a house can sometimes be a complex matter; even more so when this property is located in another country like Mexico.

In my practice as a Mexican real estate lawyer, specialized in advising US citizens as to acquiring homes in Mexico, I have seen multiple situations in which buyers have made very costly mistakes by not getting proper legal advice in due time, before closing a deal.

Mexico is a great place to invest, but like any other place in the world, commercial practices and laws vary widely from those of the United States. Clarity in legal issues is hard to foresee in Mexico without expert legal advice.

It would be a wise decision for real estate professional to suggest buyers and sellers to seek the advice of an impartial specialized Mexican real estate attorney before formalizing any real estate transaction.

Don’t make the common mistake of believing that Mexican public notaries are there to pursue the best interest of the party that pays his or her fees. This is not always true. Public notaries in Mexico are government appointed officials whose role is to certify that a real estate transaction is performed in accordance with the requirements of Mexican Civil and Tax Laws.
