Todos Santos advice/lawyer?

My good friend Ana is seriously considering buying a parcel of raw land near Todos Santos. Anyone know a good lawyer she should talk to and or be willing to give her advice on that area? She speaks fluent Spanish. Thanks! Marla

Miguel Angel Izquierdo in La Paz Is the best in B.C.S. He speaks good English. he is also a federal notary. and specializes in this kind of thing.

Please tell him I sent you and you will git special treatment and price. besides I owe him a favor.

bruce...do you mean miguel Izquierdo in La Paz on the 5th of febuary. If so I do not believe he is a registred federal notario. He calls himself a correro publico numero uno which is a made up position and does not exist.

Nice guy and all but I just wanted folks to know the difference.

We dealt with Miguel several weeks ago and he is indeed a
registered federal notario. I think it is a fairly recent appointment...if my memory serves me right he is #9 or 12???
There is also someone in Todos ...I am so bad with names...her first name is Suzie. We got really good advise from her several months ago. If you u2u me I will get a complete name and how to find her.

Lic. Izquierdo is both a Federal notary and a State notary now (very few of them I guess). He's great but VERY busy and will admit that he doesn't usually respond to email. You can feel very comfortable using him finalize a real estate transaction.

he might seem expensive when you talk to him but by the time he finishes your work you wont pay half what you would to the other shysters. he works fast and he has the connections .

I emailed you her addy along with several suggestions for realtors and the very strong admonishment that you read richard peytons "buying land in mexico" twice.

you are considering buying in pescadero specifically near cerritos beach. Check the titles carefully there, the whole ejido lottery, agrarian titles to actual clave catastral titles has been imbroiled in multiple lawsuits. Talk to a lot of folks and make sure you can get title insurance with a legit company before you give anyone dime. There is a rich history of colorful twists to the whole saga out there.

Most all title insurance issued in Mexico now includes a clause which voids insurance if there is an undisclosed title cloud/claim. Be very careful.

good point dave......you need to do your homework and ask around...talk to a lot of people locally. It is very possible that someone could be holding a title duly registered with the clave catastral office but be involved in some sort of law suit over it. Most of the time (notice the word most) the clave catastral office will stamp a title that is in dispute until the matter is resolved but this is not always the case. Usually in a lawsuit one of the first moves is to have a judge request that the title be stamped but this does not always happen for many reasons, most of them nefarious. Sometimes the judge may feel that the lawsuit is frivolous or in particular if it is a second suit by the same individual that already lost once he may refuse to have the title in question stamped, however there is still a lawsuit involved that can cloud the title and invalidate the title insurance. Many people that have been served papers ( a denuncia ) will try to sell the land before the title gets stamped or they get tired of the cloud hanging over them.

There is a man that is famous in the area for this kind of multiple lawsuits and conflicting titles shenanigans. Ask any Realtor or lawyer in the area about Antonio Salgado from pescadero. He is legendary and has an amazing ability to continue playing this game repeatedly.

Many if not all of the lottery derived ejido titles, both the yet unconverted agrarian titles and the already converted clave catastral titles, in pescadero are embroiled in some sort of suit because of the shenanigans that took place during the lottery and after words with the development company that did the subdivisions, roads, electrical and water lines.

Take a look at the official subdivision map and overlay it with a topo and you will see that it will be virtually impossible to build on just about all the lots that are on that peak that sits between cerritos beach and the land at the end of the shrine entrance road (where Barb and Richie's house is)

many people who got those lots feel screwed because they saw really nice flatland ocean front lots mysteriously go to the Delegada at the time and her "associates"

I think you get the picture....It's a royal mess that will take many years to sort out.

we had the assistance of Miguel Angel Izquierdo last year when purchasing our home in baja. i would highly recommend him. he has an excellent reputation, he is very trustworthy, easy to talk to, and very up front. we were very pleased with him.

You have sold me and I was not even asking yet. So could someone ball park his total fees? Once again, we have located a property in La Paz, as as luck would have it the folks representing it had a visural response with the buyer agency and believe they are almost willing to walk away from the deal. I need to find a person like Miguel Angel Izquierdo y Viamonte appears to be. This is the 3rd oddity of recent and we want to close this deal!
