Missing Nevada Girl: Focus Shifts to Puerto Nuevo

Lyon County investigators say the trail of 8-year-old Lydia Rupp has gone cold. She was kidnapped from her Fernley, Nevada home six days ago. But Mexican authorities are changing their focus believing Rupp and her abductor, Fernando Aguero, are still in that country.

This week the search for Lydia Rupp and Fernando Aguero has centered on Tijuana, Mexico where they were seen Sunday. Eyewitness News has learned the focus now has shifted south of Tijuana to Puerto Nuevo, where Aguero has friends and family.

Private investigator Bill Garcia says, "I feel the little girl is still alive, and based on the witness statements is in good shape." Garcia is on Aguero's trail, as is a division of the Mexican federal police.

While in Lydia's hometown of Fernley, Carmen Bauer, Lydia's mother, prays to God. "She had angels around her. She is not alone. She is covered with his angels."

Investigators do not know why Aguero, a convicted sex offender, kidnapped Rupp. But one group has a theory.

"Why would he take the birth certificate? Why would take the social security card unless he was going to start a new life with this child?" Frank Mahoney with Nevada Child Seekers believes Aguero kidnapped Rupp because he wants to raise her as his own child.

Mahoney continued, "She considered him daddy, as a parental figure." It is that trust that allowed Aguero to take Lydia Rupp from her mother, from her home, and into Mexico.

In Fernley, Nevada, residents are urged to wear purple ribbons as a symbol of unity while the search for Lydia Rupp continues.

Fernando Aguero has a previous conviction for sexual assault, but on Thursday Eyewitness News learned Aguero never filed with Nevada's sex offender registry.

A heads up, to keep your EYES OPEN for a this creep who is supposedly now in Baja. We were stopped in El Rosario last night, by under cover "Mexican FBI" who are searching for this scum bag. Apparently he has been making his way down South and was last seen in San Quintin and heading towards the great town of Rosario. They said that they have frozen his accounts and should be almost out of money. So everyone keep your eyes open, I am sure he is just going to try and blend in, at one these towns and who knows what he will be up to next... Also, apparently he doesn't speak much Spanish, so he should stick out. I hope the Mexican authorities get a little time with him first, before our Feds get a hold of him.....

Just read in the paper they got him in Ensenada.They were expected to reunite the girl and her mother today.

Convicted Child Molester Back Behind Bars
Convicted child molester Fernando Ayala was arrested Friday, July 29, 2005 in Ensenada, Mexico in connection with the disappearance of eight-year-old Lydia Bethany-Rose Rupp. Lydia was found alive and authorities are conducting medical exams to assess her condition.

According to officials, Ayala kidnapped Lydia Friday, July 22, 2005 from her Reno, Nevada home. Lydia's mother returned home from work that day to find her child missing and no sign of her live-in boyfriend, Fernando Ayala. After a week long search, authorities are thankful that the convicted sex offender is back behind bars awaiting extradition and that the young Nevada girl has been safely recovered.

Tip leads police to Ensenada shelter

TIJUANA ? Mexican authorities detained yesterday a convicted sex offender and the 8-year-old Nevada girl he is suspected of kidnapping from her mother's home after receiving a tip that the two were at an Ensenada homeless shelter.

Alfredo Arenas, chief of the State Preventive Police's international liaison unit, said they hoped to hand over Lydia Bethany-Rose Rupp to U.S authorities by this morning.

The girl and Fernando Aguero, 47, first were to be interviewed by investigators at the Baja California Attorney General's Office, he said. Arenas said it was unclear whether Aguero would face charges in Mexico or be deported quickly to the United States.

Following Lydia's July 22 disappearance, a warrant for Aguero's arrest was issued in the United States on first-degree kidnapping charges, said Lt. John Arndell of the Lyon County, Nev., Sheriff's Department.

The massive, bi-national search included an Amber alert and the placement of posters with Aguero's and Lydia's pictures in Tijuana and other Baja California coastal cities. U.S. authorities believed the pair had crossed into Mexico, where Aguero has family.

Yesterday, "a woman who runs a homeless shelter in Ensenada called to say that a man and child were there who looked like the ones on the poster," Arenas said.

Four state officers went to the shelter and checked the man's identification. Aguero was unarmed and didn't resist being taken into custody around 6 p.m., Arenas said.

Lydia "looked very confused and shocked about what was going on," Arenas said. He said the girl hadn't yet been asked whether she was sexually assaulted by Aguero in either the United States or Mexico, because "we need a specially trained person to talk to the minor."

Arenas said Lydia appeared to be clean and well-cared-for and showed no signs of trauma. He said she may undergo a medical exam in Mexico.

Arndell said Lydia's family was "ecstatic" upon hearing the news of her discovery. He praised Mexican police for their efforts.

"They went out looking for her, and they found her," he said.

He said the girl would probably undergo a medical exam in the United States, as well. He said efforts were being made to bring the girl's mother to San Diego so they could be reunited this morning.

Lydia's mother, Carmen Bauer, met Aguero at a church function in April, and he moved into her home. Aguero is a convicted child molester, but Lydia's mother said she didn't know that, according to the Reno Gazette-Journal. Aguero apparently did not register with local authorities, as sex offenders are required to do, according to the report.

RENO, Nev. - An 8-year-old girl was abducted by a convicted sex offender who took her to Mexico, where the two were found staying in a shelter, authorities said.

Officials in Mexico and the United States said the girl was sexually assaulted by Fernando Aguerro, who is accused of kidnapping her from her home near Reno on July 22.

The girl was reunited with her mother, who had a romantic relationship with Aguerro, on Saturday.

The girl?s name was reported as authorities searched for her, but the Associated Press does not normally identify victims of sexual assault.

Aguerro, 47, and the girl were found in a low-income shelter in Ensenada after people there recognized them from flyers distributed in the state of Baja, Mexico.

The mother flew to San Diego on Saturday with Lyon County sheriff?s Capt. Jeff Page and was reunited with her daughter later in the day.

It was not immediately known when Aguerro may be extradited to the United States. He remains in the custody of Mexican authorities, who want to charge him with rape and kidnapping, NBC TV affiliates in Reno and San Diego reported.

If convicted in Mexico, Aguerro could serve up to 38 years in prison.

Aguerro ? who was convicted in Los Angeles in the 1980s of lewdness with a child and served a year in prison ? could receive life in prison without parole if convicted of kidnapping in the United States.

The girl?s mother said she did not know that Aguerro was a convicted sex offender until he and her daughter disappeared. ?I?m glad everybody prayed? for the girl?s safe return, she said.

The wait for a Nevada mother is over. Her 8 year old daughter who was kidnapped more than week ago by a convicted sex offender is back with her mom. The search led to an International effort by U.S. and Mexican authorties.

Carmen Bauer, was anxious to see her daughter for the first time in more than seven days, but before being reunited, she learned her 8 year old had been sexually abused for quite sometime, by the accused kidnapper.

We are no longer using the young girl's name. It is our policy at Channel 8 not to use the name of sexual assault victims.

Carmen Bauer was driven into Tijuana, Mexico, where Mexican Federal Police were on hand for security reasons. Before the news conference, the suspected kidnapper, Fernando Aguero was shown to the media. Aguero is the man Bauer once had a committed relationship with, "My relationship with Fernando, we were roommates, boyfriend and girlfriend, but no sex between us, we did discuss getting married in the future."

Bauer went on to describe Aguero's relationship with her daughter, "He loved her, they were very close they became like father and daughter they got along very well." But Bauer's casual demeanor quickly changed when the Baja California Attorney General, Antonio Mart?nez Luna made it public for the first time, that Bauer's daughter had been raped by her accused kidnapper. "He said that four months previous to today he had sexually assaulted and molested the little girl and decided to bring her to Mexico, says Luna.

The shocking news was too hard to bear for Bauer, and she attempted to leave the news conference. But moments later, the mother and daughter were re-united. The hugs and tears are endless. After several minutes of embracing, and Bauer caressing her daughter face, both are escorted out and given time to themselves.

Attorney General Luna believes Aguero may have more victims out there, and he wants him to face the maximum punishment, "At least we think there's more, and in Mexico we will convict him and ask for 30 years."

Lyon County Sheriff Department Captain Jeff Paige is just glad the 8 year old is alive, and says this about aguero, "To be quite honest with you, if he rots in prison in Mexico, we're just as happy as if he rots in prison in the U.S."

The 8 year old and Aguero were found Friday evening at a homeless shelter in Ensenda, Mexico. Mexican police say Aguero's most recent assault on the 8 year old was sometime within the last week of their disappearance.

A Fernley girl found safe in Mexico a week after a convicted sex offender allegedly abducted her is due home today, but Mexican officials may want to keep the suspect for years, an investigator said Saturday.

Mexican officials have indicated they may sentence suspect Fernando Aguerro to 38 years in the Mexican prison system for the alleged abduction of 8-year-old Lydia Bethany-Rose Rupp on July 22, said Lyon County Sheriff?s Capt. Jeff Page.

Though Aguerro has not been found guilty of any crimes, Mexican authorities have indicated they would like to sentence Aguerro within 7 to 14 days, Page said in a telephone interview from Tijuana.

?They do things differently ...,? Page said of the criminal justice system in Mexico, where lawmen held a news conference Saturday in Tijuana. A handcuffed Aguerro ? his head down ? appeared before the TV cameras while two law enforcement officers dressed in masked hoods and black SWAT-like jumpsuits held him by the arms.

U.S. officials are not demanding that Aguerro be extradited, and Mexican officials will allow American investigators to interrogate Aguerro, San Diego TV station KSND reported Saturday night.

Page said he has not spoken with the suspect, but the U.S. Consulate Office is now involved. ?They are talking with him now,? Page said.

No timetable was announced for resolving the matter.

?Of course we want to bring justice,? Page told reporters in Mexico. ?Detectives would like to see him convicted in the state of Nevada and serving time in a penitentiary in the state of Nevada. I have no doubt in my mind that that will eventually happen, whether that?s 38 years from now or five years from now ? whatever it may be. At this point in time, we don?t care.?

In Nevada, Aguerro has not been charged in the abduction, though a kidnapping-related warrant with $1 million bail is in place in Lyon County.

Meanwhile, Lydia and her mother ? Carmen Bauer ? were reunited Saturday in Tijuana.

?Our No. 1 goal was met today,? Page said. ?Mom and daughter are together.?

Bauer, accompanied by Page, arrived Saturday in Mexico. An FBI crime victims? fund paid for the trip that included airplane travel to San Diego and a car trip to nearby Baja California, Mexico.

?I am glad that everybody prayed and glad that everybody got together to help Lydia,? Bauer told KRNV News 4 before boarding a jet at Reno-Tahoe International Airport.

Lydia was staying in a Tijuana-area hotel Saturday and along with her mother, meeting with an attorney general of Baja California, Page said. Lydia ?is in very good spirits,? he said.

TV images Saturday showed an energetic Lydia in a windowed staircase of an unspecified Mexican building.

Page credits Mexican law enforcement with the girl?s safe recovery.

?I wish every law enforcement agency cooperated as well as Mexican authorities did because they are the reason she was found,? he said.

Lydia and Aguerro were found Friday at a shelter for low-income people in Ensenada, Mexico. Residents there recognized the two from fliers publicizing the alleged abduction. The California Highway Patrol had translated the Nevada fliers into Spanish and provided them to Mexican authorities, who took it from there, Page said.

?They were spread to every town and village in the state of Baja,? Page said. ?We are very happy with the result that the FBI, CHP and local law enforcement in San Diego County provided to us.?

Friends of Lydia and her mother are looking forward to their return to Northern Nevada, set for today.

?God is good,? said Pastor Matt McCreary, a family friend. ?He has answered our prayer.?
