Exit searches

fulano - 7-20-2008 at 10:50 AM

It appears from this article that ICE has set up blocades at the border going INTO Mexico and is searching for guns, money, drugs and indocumentados.

That's exactly what I have been suggesting for along time. I was hoping the Mexicans would do it themselves though!

Saw ICE setup on US side of Otay crossing this July 10 and July 16. Orange cones and approx 8-10 agents were stopping autos 100 meters before Mex border.

Don't know what the conversations were like as I only cross at Otay going north to US and cross south coming home at SY/TJ. No ICE checkpoint going into TJ, but, read a report on it this spring in SD Union-Tribune.

Good...It's about time...all these guns are coming in from the US...Easy to buy there...

I guess anythang is legal. Thought probable cause was necessary. OOPS, not any more! Dang Constitution sure can't make up it's mind. Heck, why don't they search peoples homes before they head south. It's really none of their f--ing biz WHAT I have in my car in Mexico. Is it??:O

Woosh is right.

Not New

It has probably been 4-5 years since I first saw an exit inspection at the Mexicali Eastern crossing. They put out cones and routed everyone into the Secondary Inspection Building.

Well, under your theory, inspections before boarding an airplance would also be illegal. Have you heard of the "Border search exception" to the 4th Amendment?

Quote:
The border search exception is a doctrine of United States criminal law that exempts searches of travelers and their property from the Fourth Amendment warrant requirement.

The United States Customs and Border Protection (CBP), a division of the United States Department of Homeland Security, is permitted to search travelers and their belongings at the American border without probable cause or a warrant. These searches are therefore exempted from the Fourth Amendment warrant requirement. Pursuant to this authority, CBP may generally stop and search the property of any traveler entering or exiting the United States at random, or even based largely on ethnic profiles. However, CBP may only conduct searches of the traveler's body — including strip, body cavity, involuntary x-ray, and in some jurisdictions, patdown searches — if the Customs agent has reasonable suspicion to believe the traveler is concealing contraband.

United States v. Montoya de Hernandez, 473 U.S. 531, 538 (1985)

Last time I was stopped by CBP before crossing into Mexico at Otay, they asked me if I was carrying more than 10K in US currency.........I started laughing so hard I cried!!!!!!......The inspector started laughing also and waived me through.

If they can listen to your telephone conversations, read your e-mail why not search your car leaving the country.
