PROFEPA AND SEMARNAT

Can someone explain the functions and responsibilities of PROFEPA and SEMARNAT and their relationship to each other please? SEMARNAT requires environemntal assessments on land for development; PROFEPA closed the campground at Scorpion Bay.

Experiences with either?

My take, and it could be wrong. Your right on about SEMERNAT. PROFEPA is the enforcement arm for many other government agencies. But in my biased opinion of PROFEPA, they're here to put a little or a lot of misery in our lives. Even SEMERNAT fired them for awhile during their rampage through Punta Chivato.

PROFEPA has not closed the campground. The new barbwire fence that was mentioned is a result of an ongoing property dispute and the campground "boundaries" are currently in a state of flux :spingrin: It's the land of rumors and I've yet to read anything online that accurately describes the events there so don't base your PROFEPA info on any San Juanico campground postings Marla.

We've spent several thousand dollars on both SEMARNAT and PROFEPA to date, as well as many years and have a collection of a few interesting documents, but still nothing official in our hands with all the stamps on it. So I could tell you what both agencies are supposed to do, but I've learned that how the environmental laws are interpreted and enforced is a whole different thing.

I used to think i was somewhat knowledgeable about the process required for building a house, but the only thing I know for sure is that how much the whole thing will cost depends where you're located and and who you're working with. I'll let you know if we're ever finished, and finished paying. ;D

A carload of inspectors arrived in Palmas bay one day about 3 years ago, checked some seaside homes and resorts to find almost nobody had done environmental impact studies (EIS) and got permits. So they went from door to door posting notices. Those who could respond did so and scores of infracctions and fines brought more interest from PROFEPA in La Paz in the form of bigger vehicles filled with more inspectors. By the time the busloads of cadres of imported inspectors left the far end of the bay at Los Frailes they had pretty much stung everybody near the water for a rumored $400,000 dollars. Not long afterwards, while some of the cases were still before judges, they took another swing through and got a lesser amount (some from the same stingees - for the same infractions). Here it really boiled down to how much can you reasonably be expected to pay attorneys to fight what you believe is new/wierd/rotten rules for beach property buyers.

From my perspective profepa and semarnap are really just stealing money under the guise of environmental protection. It's just a scam because they act like they are protecting the environment and demand you pay for exorbitantly expensive studies cataloging cactus, trees, and other plants then they let you do anything you want after putting some yellow tape around a few token cacti. The whole thing is a joke, I know from personal experience that the profepa guys from La Paz are completely corrupt and will ask for bribes not to harass you. It's just another example of greed that hurts the local economy by discouraging people from building.

You're a brave guy Monkey. You want to go on record here publicly that Semarnat and Profepa are theives? Can we see more of your bravery? Tell us more about the jokes, the bribery, the corruption, the greed.

Some of us expat homeowners here don't see what you have encountered. We're just fat, dumb and happy to be living in this place, warts and all. I just reported what did happen here. What can happen. Beyond that inquiring minds need abogados, not fishermen.

I'm just passing on what I have experienced first hand. I have a piece of property that I would have built on long ago but I refuse to play their game.

This is what I went through. When S & P came through here they hit almost every lot owner. I'm wondered why they didn't approach the ejido or individual parcel owners to make the land use changes on a larger scale. Most of us along Shell Beach bought the lot already cleared by the parcel owner. And yet the lot owner was help in violation. I can understand being held responsible for making improvements without the proper permits. Although it would have been nice when we received our building permits if we were notified at that time there were State & federal issues to resolve prior to construction. As far as I know there is not a list of requirements/permits needed prior to making improvements. My feeling is that prior to signing the bank trust the buyer should be made aware of all the requirements. Some people here went to SEMERNAT and were guided through the process. Others were told to hire someone. All very confusing for some one unfamiliar with how things are suppose to work down here. Many of us were fortunate that PROFEPA botched the handling of the paper work so badly that, in my case any way, a federal judge at the highest level threw out all the infractions and stated that SEMERNAT or any other agency could not reissue the same infractions. Case settled? Oh No. If I do any further improvements I must produce an environmental study and any required permits. At least now there are specific guide lines to follow for all that. So it is getting better. I think:?:

both government agentcies in la paz
seem to be honest and professional

we were treated with dignity and respect at both

semarnat issues the permits

profepa are the "semarnat police"

They must have been on dope that day.... and you were lucky.
They are just as described by Elgatoloco.. a bunch of rats. They
don't have moral, ethic principles. They got the job just to gain
power to extort anyone they can. They are rats. They steal from all of us and each other. They should be all fired and jailed.

Sounds familiar. Lots of people here still haven't received their final settlement. Most of the fines are in the $10,000us area. I was very lucky. I only took me 3 years.

The Scorpion Bay campgrounds are open - yes PROFEPA closed the cantina and the palapas August 6th but the campgrounds are open. The fence was built by interests who wish to close the campgrounds and keep the lessees out. This was the 8th inspection by PROFEPA in just over two years - the previous 7 have were dismissed with findings of no harm. PROFEPA doesn't do inspections that consistently come to naught without receiving gas money.
