"We completed our annual trip to Mexico yesterday after 2 weeks of wonderful and uneventful travel on the mainland. I have 15 or 20 E-APIS border
crossings under my belt since the mandatory requirement was initiated last year but this one takes the cake.
We were staying in Teacapan, MX, which is about 70 miles south of Mazatlan , where we had internet access. We decided to head home on Monday, March
29th The flight to our chosen Airport of Entry was 7 hours with no wind. I did not have enough fuel to get far enough to comfortably make the trip
with only one fuel stop and since I wasn’t sure we would make the trip in one day I filed my E-Apis for Tuesday the 30th.
As luck would have it, we got an early start Monday morning with clear, smooth skies and a tailwind. We stopped for fuel in Los Mochis and continued
north to Punta Penasco where we arrived at about 2:30 in the afternoon. They opened a new jetport in Penasco in November, so instead of landing
right downtown you are now in the middle of nowhere 20 miles south of town. Where it used to cost $4 for a cab from the airport to Rocky Point it is
now 30 minutes and $25. So I decided to see if I could call customs and amend my E-apis telephonically. I had just downloaded and read the latest
E-APIS guide effective January 2010 and it says:
On a limited case-by-case basis, CBP may permit a pilot to submit or update notice of arrival or
departure and arrival/departure manifest information telephonically when unforeseen
circumstances preclude submission of the information via eAPIS. Under such circumstances,
CBP will manually process the notice of arrival/departure and traveler manifest information
provided by the pilot; the pilot is required to wait for CBP screening and approval to depart. In
these cases, the pilot should contact the CBP airport of arrival/departure for assistance.
So I called Customs at the AOE. I had a retaliation issue with Customs a couple of years ago so I am not going to mention where we entered. I asked
the agent if we could amend our Notice of Arrival date since we were way ahead of schedule. He said yes but you have to do it electronically. I
explained that that would take well over an hour in Taxi rides and about $50. He said “Well, you can just show up without filing and all we do is
give you a verbal warning that you were in violation”. I told him that I was under the impression that I would be subject to a minimum of a $5000
fine for doing that. He said “that is true but, so far we are not issuing fines.” Great I thought, so I asked if I could schedule my arrival with
him since it was my understanding that you also have to schedule directly with the AOE for an arrival. His response, “If you schedule with me now I
will have to inform you that arriving without an E-Apis for the correct date is a violation in which case if you choose to enter we will violate you
with a fine.”
So I recapped the situation with him. If I neither file nor make arrangements with CBP to return to the US and just show up I will be given a verbal
warning not to do it again, but if I do everything correctly and try to amend my intentions via telephone I am subject to a fine. His response,
“that’s correct”.
Call me paranoid but I don’t believe in verbal warnings, everything stays in a file, so we just spent the night in Rocky Point and arrived the next
day on schedule.
I hope all Americans feel safer with this system in place."
