News article claims theres a warrant for the arrest for the owner, i am trying to contact some friends there and all i am getting is that the cops and ministerio publico where there this morning.

On their over for coffee this morning two friends saw two P/U's with what they thought were police piled in the back, Not military, right at the crest of the hill where Raul & Bobby where waiting. Raul was not real friendly so they continued. I'll ask around and see what the latest rumors are. But if Jeffery hears something I'd like to know something other than rumors I'd likely pick up.

Just talked with Mike. Appears, this is really great and funny as hell, Marcillette (sp) got caught blue handed so to speak stealing water. The water company has known for some time that someone has been boat legging their water and today or yesterday they put dye in the leg of the water line where the meter readings haven't been adding up. Well when Marcillette answered the door this morning he still was wearing the blue dye. BUSTED! Evidently he had tapped into the line the feeds a couple places where the store use to be. So, as i understand it, it wasn't the hotel that was stealing the water but it's owner for his home near the hotel. Couldn't have happened to a more deserving guy! Hope he spends some time at the BIG free hotel in Santa Rosalia!

That is way too funny, as I was leaving Punta Chivato this morning I got passed by a green pickup that was going like a bat out of hell, he went up past the guard shack and pretty soon was escorting the Minesterial Policia in a cloud of dust and they were going at a great clip. Thinking it might have something to do with a friend who has had some difficulties with neighbors, I turned around and followed them for some time but when they passed his place I did a U turn and left. Part way up the road I met the second Policia.
This has to go down in the annals of Baja History as a great story. Can you imagine getting caught red handed and "Blue Bodied".

Well, over the years the new Italian owner of Punta Chivato's hotel and another to the south has really irritated old customers by jacking the rates way way up in order to exlude 'lower class' Americans for his snob European clientel... Was just hoping it was that guy.

He just got married... again... and she's really nice and he has a brother that was here for awhile the people liked also. But of course he's got money & people with political power so he'll never do the time. BTW I'm told stealing water is a major crime here. Also I should mention that the owner of the water company has some powerful friends too. This should play out to be worthy of a lot of local gossip.

example One
Doña Julia has a restaurant here that most of the workers eat at. Marceletti had agreed to pay per worker per day. After 2 or 3 months she confronts him and asks for payment. He brushes her off and tells her to submit an itemized bill. Now you can imagine that her business is run pretty much on a shoe string and the gringos that frequent her is about all the money she's bringing in and the payments Raul is making for his work crews that eat there also help. Now some more time has passed and Doña Julia presents Marcelitti with an itemized bill and he looks it over and tells her that the total is what she owes him for the electricity he has been providing her. And then cuts her power off.
example Two
He has done a magnificent job of remodeling & building the hotel. Really first rate. No expenses spared. He has lots of heavy equipment and the operators to handle them. After hurricane John he begs the community for help feeding his workers. And of course we pitch in and take care of the problem. Mind you the hotel has a restaurant. And this is after his heartless dealing with Doña Julia and she has no supplies either. So... here is the community that has no way out because the roads are impassable. Rual has his people working on the road and helping everyone with the damage from the hurricane and not asking for any payment. However he needs a heavy duty 4x4 loader and Marcelitti is approached to help out and Raul has offered to pay for fuel. He says there is no operator for the equipment and says no, later in the day Marcelitti gets his SUV or truck stuck and an operator shows up with the equipment requested and pulls him out.
These are just two examples of his attitude towards the community he has chosen to run his "5 star" hotel in. There are of course a few examples of his opening his restaurant up for a few community events at a price of course and to politicals to spread their propaganda. Nothing, I'm aware of, out of the kindness of doing business in our community.
So, I'm not saying everyone "hates" him. However there is NO respect for him in this community. You might inquire about his operations in La Paz and else where. I have no knowledge of how he's thought of elsewhere.

August '07. My wife and I drive to Cabo and surrounding areas for our honeymoon. A couple days at a relatives in San Bruno, so we head to Chivato for a day trip. Awesome area! Nice hotel! Let's go have a nice lunch and a few cold ones. Now, we were dressed well, driving a brand new truck. As we walked in, people in the pool looked at us a little funny??? At the bar, we were told " Sorry, guests only". Yeah, all 6 of them! Maybe if we flew in, the reception would have been different! I will never spend a dime there! Attitude is everything in the service industry. He better be mega-weathy, cause with that attitude, he cannot be turning a legit profit. Stealing water, low, low move!

I never said it 'IRRITATED ME'... I have NEVER stayed there, I visited once when it was closed down in 1973. As someone who has been following Baja news for 40 years, I made the comment... no politics mentioned...

Como amigo cercano de una de las familias directamente afectadas y con su permiso, me gustaria aclarar algunos puntos:

1. En este caso en particular, se recibio el apoyo sin ningun contratiempo de las autoridades estatales a las que se les agradece su pronta respuesta.

2. El sr Marcelletti tiene fama de presumir sus influencias, y la mayoria de las veces, se a probado que no son reales. Por lo tanto, y teniendo en consideracion que las propias autoridades estatales participaron en el descubrimiento e inicio de esta investigacion, estamos totalmente seguros de que esta es una mas de sus mentiras para tratar de salir del problema.

3. En otras ocasiones, el sr Marcelletti a declarado ser amigo intimo de presidentes, embajadores, personajes Italianos, y mandatarios de diferentes naciones europeas, por lo que cualquier comentario de este sr se debe de tomar con las precauciones debidas.

4. De que se cometio un delito, se cometio, pero en ningun momento el gobernador del estado a tenido nada que ver con el tema. Prueba de eso es que las propias autoridades estatales fueron las que tomaron cartas en el asunto.

5. Es muy probable que los comentarios que relacionan al sr Marcelletti con personajes de la vida politica, sean producto del propio sr Marcelletti, que a travez de los años a demostrado ser una persona conflictiva, problematica, y experta en hacer turbias las cosas para salir beneficiado. En este caso en particular, solo se a recibido apoyo del gobierno del estado y nada mas.

Cualquier duda o aclaracion , estoy a sus ordenes, proximamente las partes afectadas haran sus comentarios dandole validez a lo que expuse aqui.

MULEGÉ, BCS.- El Agente del Ministerio Público del Fuero Común Investigador sorprendió ayer en flagrancia delito -robo de agua del acueducto propiedad de la empresa denominada Punta Chivato- a Guisseppe Marchelletti Pandolfi, de nacionalidad italiana y propietario del Hotel "Posada de Las Flores", ubicado en la zona conocida como Punta Chivato, municipio de Mulegé, Baja California Sur.

De conformidad a la información obtenida basada de la Averiguación Previa número LPZ/009/AES/2010 integrada contra Guisseppe Marchelletti Pandolfi, por motivo de la sustracción ilegal de agua del acueducto propiedad de Punta Chivato.

Ayer 30 de agosto de 2010, se apersonaron servidores de la Procuraduría General de Justicia del Estado -Agente del Ministerio Público, Grupo Ministerial, Peritos Fotógrafos e Hidráulicos-.

Así como los apoderados legales de la empresa licenciados: Ceciah Betsabeh Gómez Reyes e Isaías Reyes López, motivados por una orden de inspección ministerial, con la intención de asegurar las instalaciones del antes mencionado, y descubrir la toma clandestina que se encontraba conectada al acueducto propiedad de la empresa "Punta Chivato", desde hace aproximadamente 5 años, de la cual se sustraía ilegalmente agua.

Dicha diligencia se inició aproximadamente a las 09:00 horas de ayer, haciéndose levantamiento y descubrimiento de las tomas clandestinas que Marchelleti tenía conectadas al acueducto, mediante la cual, de manera fraudulenta, dolosa y con total mala fe, suministraba agua potable a sus instalaciones.

En dicha diligencia se dio fe Ministerial, tipificándose el delito de "despojo de aguas". La mencionada diligencia se concluyó a las 20:00 horas aproximadamente.

It is a big deal if you have an interest in Punta Chivato. Also if you feel that you're paying too much for water and one person is taking 1/3 or so of the water the community receives and not paying. If you think that he is taking that water to fill his swimming pool for a very few clients he over charges and gives nothing to the community that he has alienated himself form. "Azulito" has made a name for himself in this area and it is important that justice is served. However not many believe it will be.
Oh, by the way, it is not an "old hotel" nor is the story about "a pipe with blue water". It is about a rich arrogant foreigner stealing a lot of water. Water is a Very big deal in Baja and it belongs to the people and regulated by the state. I suppose I should stop here, for now, cuz the sun is rising and I should get on with life. :fire:

We have had zero problems with our water well supply and usauge in over 40 years of operation. Plenty for all if used reasonably..no charge, just help pay maintenance/expense of pumps, tanks, etc. If someone had been diverting or endangering that commodity, I think a lynching mentality would have emerged from the users.

I wonder if thats the reason why our water bill has always been strangely high? My father and I could never figure why our bill was so much. We fixed leaky sprinklers,sinks, and we even shut off our valve at the meater when we left. HUMMMMMM
