I found this on another baja site and thought it news worth sharing....


An article in the August 20, 2004 Sudcaliforniano newspaper stated that the Mexican Supreme Court heard the case involving the claim of the ajido in Mulege against Don and Nancy Johnson. This is the final appeal and the ruling stands as law. The court sided with the ajido stating that the documents Don and Nancy Johnson had presented as proof of ownership were "false and fraudulent". The court ruled that the Johnsons had never legally owned the hotel, that it had belonged to the ajido all the time.

A meeting has been scheduled with the court, the ajido and the Johnsons to set up a schedule for turning the hotel and its assets over to the ajido. There is an offer on the table for the Johnsons to stay if they pay back rent of $2,000 per year back to 1967 and to continue to pay rent for as long as they wish to run the hotel.

I am sorry to hear the News.
Next time you are in Loreto go by and look at the Hotel Mission.That is the Result of the same thing that has happened to the Johnsons.

until then i'll only put pure speculative money in states side investments. i don't have enough to indulge higher forms of risk. would be nice though.....i can't be there enough out of the year to justify the holding though. if i had 6 mos. ea calendar now i'd do it...maybe, 1st the MMLT airport has to get pilot friendly . right now they suck!!!

The BBP has received many calls and emails over the past week. The phone calls were BBP members with questions about an article posted in a Mexico newspaper. This article indicates the courts have ruled in favor of the ejido in an ongoing land dispute between the ejido and the Hotel Serenidad.



In a discussion with Don Johnson, owner of the Hotel Serenidad, he has indicated some of the information in the paper is correct and some is not. A appeal has been filed and until a decision has been made it is ?business as usual?. The hotel is fully staffed and operating 100%.



Also note that work has been done on the airstrip and is reported to be in excellent condition.

The explanation is now easy to follow.
If this article is true, well, the Hotel will be closed down.
Ejido's don't operate things well, but have absolute power over it's lands and operations.
Never get involved with anything with one.

a spin on the facts. Typical of the press, they are somewhat sensational on this matter. Don will keep the hotel, strip and operation for a good long while. There's so much more to this that is not being published, i won't comment on any of it here.

I don't remember when exactly, but about 10 years ago I thought the Mexican government changed the laws that govern Ejidos so that individuals in the Ejido were given property rights that allowed them to sell their section. Maybe I'm wrong and it had to do with property a certain distance from the ocean and border.

i just spent a few hours with the Johnsons touring our development in San Diego, they came up from TJ to look at our TowneHomes today, from Mulege yesterday. They are in fantastic spirits and excited about the fall return of all their friends and BBPers to the Serenidad. As Jack says - it's bidness as usual!! (Don even paid my utilities bills over the summer months while my plane was down and i couldn't get down to hit dorados!) What a bunch of the nicest people you'll ever want to meet!! Let's all try and get south to mulege often this year. Viva Hotel Serenidad! :yes:

Glad to hear that it's working out. Once all the confusion settles we could suggest a merger between the folks at Cielito Lindo in San Quintin and the Serenidad for the Saturday night pig roast. But, come to think of it, I guess Porky wouldn't look good on a spit. Sniff!!??

And I will remind everyone again. The gringo gazzette is run by some pretty snobbish folks that know very little about Mexico and Baja. It doesn't stop them from constant rudeness and a disrespect for the Mexican people though.
