Stopped by police in Constitucion today—Wednesday

Marla Daily - 12-28-2011 at 05:16 PM

For the second time this trip we have been pulled over. (We were stopped in Tecate a few weeks ago.) This time it was in Constitucion. Alleged crime? Dogs in the cab of our extended-cab truck. And yet again we talked our way out of it by speaking Spanish and being polite. This is getting tiresome!

bkbend - 12-28-2011 at 06:22 PM

If you found out it was against the law in Tecate, why would you continue the same behavior and expect a different result? I'd keep the dog out of sight when I got to La Paz.

I told Marla to get that dog a driver's license.

We were stoppen in Mexicali by a bike-cop. Ostensively it was to see if we were wearing seatbelts, but when he saw that we were, indeed, belted in he said that it was illegal to have our JR terrier on the front seat (between us at the time).

I showed him Scooter's driver's license. At first the cop looked dumbfounded, then he broke out a gigantic smile and waved us on.

Here's what his "driver's" license looked like.

Allen R

Edit: Sorry. I don't know why the photo didn't load. I used the same procedure as in the past. In fact I have a 'custom' size that I've used for Nomads before, but it doesn't seem to work. I don't have time to fool with it now, but the AZ DL for pets looks very similar to a real license.

Read of a tourist also coming thru Mexicali,
pulled over, dog in back seat, the Mex Cop told
the driver, get this, the dog had to be in
a seat belt

viabaja - 12-29-2011 at 04:16 PM

In Mexico, all dogs must be in an approved harness and either attached to the seatbelt or clipped to a bracket. That is the law. Some US states have the same rule. I understand the reasoning. Lock your brakes doing 55 and one will have that 70-80 dog going by you and into the windshield.

Roberto - 12-29-2011 at 04:53 PM

Could you provide info on this law? How did you find out about it?

Yeah, I find it hard to believe you can pack ten people into the back of your open truck and your dog is the one that needs the seatbelt. But- if there is money to be made by ticketing gringos with dogs in their cars- it could be true.

dog seat belt ??

captkw - 12-29-2011 at 05:43 PM

wow, this is new's to me !! I got stopped twice in la paz for having my dog out the window with my arm around her and was showed the infraction in the card thing they carry....some like" un brazo/pelegrosso" but if this a new law,and is it relly a law,, and /or are some gringo's buying it and the cop is doing the mordida...would really like some more nomad's take on this,,,K&T

Where do you get this nonsense?
Quit spreading unsubstantiated fear among the expat communities and our guests if you can't give a reference.

Currently there are no laws in the U.S. requiring that dogs, cats, or hamsters have seat belts, and that's a FACT.

I doubt that Mexico has such a law either.

Marla Daily - 12-29-2011 at 07:41 PM

I'm the OP. I have not been able to find any law about dogs riding in a car in Mexico. The rear seat of a king-cab truck is no different than dogs riding in a car. Our dogs each have their own bed or throne in the cab in which they ride.

It is not illegal in California. I seriously doubt it is illegal in Mexico. Both times we were let go without paying a fine. If it were a law, I suspect we would have been made to pay the fine on the alleged infraction. My thoughts on the matter.

seat belt's

captkw - 12-29-2011 at 08:07 PM

all of my hamster's,,under my hood ,,have, seat belt's,,otherwise,, the torque ,,would spin them and then and I would lose a lot of performance..LOL..let's get to the bottom of this !!! K&T:lol::lol::lol: PS, a good new year to all !! this smell's,like a:lol: fish in a market with no ice !!

As well as correct. This bullcrap is no more than the new age stop sign, red light or speeding ruses practiced by the Law Creating Officers in Mexico. Don't fall for it. Just stand there in a mute trance and stare at the cop til he goes away.

Most states have a vehicle code violation called "Interfering with drivers control of vehicle"............

Eating, drinking, applying make-up, dog sitting on drivers lap.....whatever..........it's in the eye of the beholder

Terry....if the Baja cops knew about this and thought for a second that the travelling drivers accepted it as fact, it would put an end to tourism as we know it. The "beholder" would hold all the cards and wouldn't hesitate for a moment to play them. :fire:

if it's not a law, it should be!

irresponsible to do long trips w/o safely securing dog. the dog can become a projectile, the dog may be injured (don't care if irresponsible owner is injured).

p.s. i see this everywhere,... nothing is worse than people with rat- to skunk-size dogs on their lap while driving, that's my 2 cents! some fools even have their 80 lb labs on their lap while driving 80 mph down the 5

secureing a dog

I don't see that much, Goat. Not with dogs. I do, however, see a lot of it with small children on laps with no belts and leaning into the dashboard. They're like human air-bags, I guess.

Udo - 12-30-2011 at 07:07 PM

We drove through CC three times these past two weeks. Got two hard looks with our kayak on top but no stops. We even spent TWO nights at a motel there last week and this week.

Jack Swords - 12-30-2011 at 07:55 PM

Drove through yesterday (Thursday) about 3 PM. Nada! Police out and about, could care less. Our two dogs were in the back seat enjoying the scenery. Distance between Guerrero Negro and La Paz seems to have gotten greater.

dogs in car/truck

I guess viabaja is not going to provide his source.

There IS a law in CA against having dogs in a pickup bed without restraint, however. I'm sure that will allow the goat to sleep better at night.

In California:

California Vehicle Code section 21700:

No person shall drive a vehicle when it is so loaded, or when there are in the front seat such number of persons as to obstruct the view of the driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle.

Amended Ch. 1500, Stats. 1965. Effective September 17, 1965.

toneart - 12-31-2011 at 12:30 PM

My dog is a calm traveler. He has the whole super crew cab of my Ford F150 pickup as his penthouse suite. For all of his ten years he has ridden comfortably and safely there. He is never allowed in the front seat! We take many multiple day trips including Baja Sur. We also take short trips in town, running errands.

He would not be able to make the adjustment to a restraining device. (Neither did I.) I hate seatbelts and only wear them because I would get ticketed for not wearing it. Big Brother, insurance lobbies and cops see to it that I comply. (Leave me alone, already!)However, regarding dogs, I pass cops all the time, in the U.S. and in Mexico. They often have a clear view of my dog looking out the rear side window.

I am not refuting the report of mordida shakedowns in Baja for dogs inside the passenger compartment. I am just saying that it has never happened to me. Even if it does, I would continue to drive with my dog in the crew cab, unrestrained...lesson unlearned.

I feel confident that he and I are safe while I am driving. My objective is to create the most comfortable traveling environment for my dog. The payback is that he never whines or creates any other type of anxiety while traveling. He mostly sleeps. We get out of the truck often and pee together. :O:lol:

This is a good law for good reason. However, it does not apply to dogs riding in a crew cab or the rear seat of a car, so long as it is not in the front or licking you or otherwise impeding your driving.

My theory is that the more you do the same drive, the longer it gets. Lacking the sense of discovery, it tends to become increasing boring, with or without a dog.
