No worries - all they ever want to see is the contents of my fridge!

SFandH - 2-10-2013 at 09:18 AM

They can search anything and anywhere they want at the border without a warrant or reasonable cause, can't they?

Actually, it's even worse. You no longer have any 4th amendment rights within 100 miles of any US border, or coastline. Basically, this applies to 66% of the US population. Read this before you say the Capt is off his meds:

Barry A. - 2-10-2013 at 10:53 AM

Well, part of the "hoax" is the Media mostly failing to report that the AR-15 was NOT involved in the Sandy Hook shootings-----it apparently never left the trunk of the purps car.

Now why did much of the Media fail to report that???????? (duh, they have an agenda)

Bingo... the current lot in power and their loving media have pledged to never let a crisis fail to be exploited and used to further their conquest of our freedoms!

O.G. - 2-10-2013 at 11:13 AM

Last year I was flying to Ensenada but was still North of the border and was instructed by SoCal approach to divert to Calexico. I landed in Calexico and was met by Homeland Security; Customs; an airplane mechanic and a govt. computer nerd. They x-rayed my plane, did the usual search and took my laptop. The computer guy didn't even have to ask me for my password and started browsing through all my files. When I asked what they were looking for, he answered "Why, are you afraid we will find something...". Then got more civil and said they are searching for any electronic money transfers.

The "current lot"??

Read about the Fourth Amendment and the Patriot Act and how they conflict. The Patriot Act was signed into law in 2001 by George Bush.

And it's true, the border search exemption to allow searches without warrants and reasonable cause extends 100 miles back from the border and coastlines.

It's not just the current lot. Look at how 9/11 was used to enact the measures that this post is about and many others.

That's what I believe, coming back you give up some
of your rights, they can take a part your vehicle, search
your person, I'm sure they could find some reasonable
cause, although I don't believe they need that

It is A-OK

MrBillM - 2-10-2013 at 05:00 PM

Simple.

Don't have anything illegal on the Laptop that you don't want them to see.

Don't have anything in the vehicle that is Illegal.

Don't worry.

And .......

Don't have a problem.

It seems incongruous that you would be so worried about your 2nd amendment rights yet you don't have a problem with giving up your 4th amendment rights.

Incredulous at Incongruity ?

MrBillM - 2-10-2013 at 05:42 PM

No Need to be.

I (and the Courts) don't find THAT situation to be a violation of the Constitution.

David K - 2-10-2013 at 05:45 PM

The Patriot Act was made to protect Americans... (remember we were attacked with more deaths than Pearl Harbor, and to mostly civilians). It wasn't considered to be used against Americans... that is until this bunch took over. (this is a reply is to monoloco and SF andH, not a new sidebar topic)

Udo - 2-10-2013 at 05:49 PM

This discussion is starting to border into the nebulous OFF-TOPIC discussion.
But if the Patriot Act is really enforced to the max, we would all lose our guns.

Lets call what it is !!

I would argue that the Patriot Act and the DHS was a power grab by both sides of the political spectrum, and was absolutely designed to be used against Americans. Remember that Hitler used the bombing of the Reichstag as a reason to suspend civil liberties in Germany. Don't think it can't happen in the US.

So you believe that all of the different law enforcement agencies are not telling the truth --- along with the coroner, morticians, etc.?

The biggest problem with most conspiracy theories is that they involve way too many people; all who somehow are brought together to tell the same "lies" and cover-up stories. It didn't happen.

Real sickos created this conspiracy theory to try and convince more people that Obama is out to destroy America, which is more conspiracy sh*t, and it is really sad for the parents and relatives of those who were murdered.

It has ALWAYS been the case (at least in my lifetime) that the Authorities have the legal right to inspect ANYTHING on your person and vehicle when you are entering from a foreign country.

Including ANY paperwork you might have in your vehicle, luggage, briefcase, WHATEVER.

Given that all sorts of illegal materials can be stored digitally, WHY would ANYONE expect that media to be exempt ?

Other than those possessing said illegal materials, that is ?

I agree that we all need to verify the things that we read on the internet and not just accept them blindly as truth. As a scientist I was trained to question all "facts" before accepting them.
However, I totally disagree with using Snopes to fact check. That site is run and controlled by a husband and wife who clearly have a bias.
A better place to start is:

At least this is a nonpartisan group with no agenda to forward.

I'm afraid in examining the posts by DK compared to yours easily dispel any question of who is armed with the superior wit, with DK winning hands down. He and a lot of others have provided more help and advice to Baja travelers than any of your posts would indicate. The US 9th Appellate Court (Western United States) has decided that authorities now need "Probable Cause" to search/detain any electronic device. Probable cause is greater than mere suspicion, or the 100 mile search clause.....however, before telling any CBP officer to pound sand, you should read the decision and have a good attorney on retainer.

FEAR on the Border

MrBillM - 3-9-2013 at 06:41 PM

With an overwhelming feeling of abject FEAR and the SURE knowledge that I was about to be assaulted and my belongings ransacked without any HOPE of the LEAST respect for my most basic CIVIL RIGHTS, this afternoon I timidly drove towards the Border kiosk today seen manned by a female tyrant employed by the Fascist American state AND ...................

The lady said "Anything to Declare" ?

To which I replied "NO, except that it's a Beautiful Day".

AMAZINGLY, I was not arrested and thrown in chains into a dark cell, but waved through.

I kept expecting to be ambushed by ICE as I drove North through the Danger Zone, but I suppose I got lucky.

RIGHT ?

How things have changed Quite a few years ago I was returning home from a trip out of the country. I passed through Customs at Houston Inter National Airport. After showing my I.D. a young Marine In Full Dress working the desk Clicked his Heels and Presented me a Crisp Salute and said WELCOME HOME SIR.

Speaking of Border Bother ................

MrBillM - 3-10-2013 at 01:06 PM

Heading North and reaching the last point at which you could be detoured into Mex Secondary, there are three soldiers (two armed with Automatic weapons).

The guy in charge motions "STOP", walks around and asks me to lower the back window and then points to the rear and says "Baggage" ?

Well, YEAH, OK

"Need to look" ?

"Hay ARMAS" ?

"NO".

"OK".

Told the spouse that they seem to be unclear on the concept.

The idea is to smuggle the guns South to sell.

Isn't it ?
