My brother is coming to visit with his 5-yr-old daughter. We usually take them to Baja. Her passport has expired and he doesn't have the time to get
a new one in time for their visit. Will he have trouble getting her back into the US if he has her birth certificate? Does he also need a certified
letter from his ex-wife granting him permission? They live in North Carolina. She will be one disappointed little girl if she doesn't get to go to
Mexico this year......

he should go to the post office and renew the passport
copy the old one before he gives it up
bring the renewal paperwork with him that shows he renewed
once its in the system it will show on the USA imm computer
remember you are taking a minor into another country with different rules

Personally I would not be concerned in the LEAST with ANY of the items you mentioned, Passport, Custody Letter, etc.,
coming back to the US without a Passport is not a

his passport...so even though 3 of them had a passport and the 4 year old only his birth certificate there was not problem....at that point you are

I crossed at Tacate in April without my Passport because I forgot it no problem with driver lic the my friend had an expired passport and the officer

Just as an FYI, legally if a child is traveling out of the country with only one parent, it is necessary to have documentation from the absent parent
stating that the child is authorized to travel into Mexico. There are exceptions to this rule, which are found on the site above. Not knowing the
circumstances of this family, if there is anything sticky going on regarding custody, it's best to have your ducks in a row.

Paulina is on to something...concern shouldn't be about entering US when lack of permission is possible...the concern should be that opposing parent
might make life real miserable in a courtroom should the little one show them the plaster piggy bank!
Then again the ex-wife declared in the question isn't pointed out as problematic, only ex.

Although it would be nice to have a current passport or passport card, once you cross the yellow line on the pavement before you get to the inspection

Mom is no problem. She will give a certified permission letter and has done so for past trips....
