Out-of-country limits?

AncientDigitalDude - 12-27-2013 at 04:50 PM

I searched the forum and was surprised that this question hadn't already been asked. I received my Permanent Resident status last May and now I have an opportunity to do some consulting for a former client back in the USA. Are there any limits to the amount of time that I can be outside Mexico without jeopardizing my immigration status? I'm concerned about maximum lengths of a single trip as well as total days per year, etc.

Would you be flying or driving out of Mexico?

If you drive, how do they know you left and came back?

Howard and ALL

They have had license plate scanners at the borders for some time now !!! and records are kept !!....K&T:cool:

AncientDigitalDude - 12-27-2013 at 05:43 PM

I would be flying, so they'd know for sure!

Are you saying that crossing Northbound that on the Mexican side the Mexican authorities have plate scanners that they use when exiting?

Crossing Southbound the Americans scan but was not aware the Mexicans do. Are you sure?

If you are a citizen of the US, I do not see any problem.

They eliminated the limits on how much time you can be out of the country when they instigated the new immigration classifications.

LPR's Northbound

There are NO LPR's (License Plate Readers )at Otay on the Mexico side before you cross into the US.

The people to ask are the officials at your local immigration office, as its they who know the rules and have the legal authority and vested duty to uphold those rules.
No one else. Let us know what they say, please.

Thanks for the info. Someone down here (La Paz) posted that there was a 180-day limit but that person has been the source of inaccurate info in the past, so I'm glad I asked. The sad truth is that the INM folks here don't always know, either, and visits on 2 different days will often get you 2 different answers.

(My info block at the left says "Newbie" but I've actually been a member since 2010 and a full-time Baja resident since May, 2009.)

I specifically asked an official at immigration in La Paz, as well as a friend who is a Mexican attorney who specializes in immigration issues, they both said there was no longer any limit on the amount of time a permanent resident can spend out of the country.

AncientDigitalDude - 12-27-2013 at 07:50 PM

monoloco - that seems to be about as credible as we can get, so thank you again.

BajaBlanca - 12-28-2013 at 12:03 PM

That is such an important question. Just to confirm, I am also going to consult an attorney.

School of hard knocks - bigassed 2,800 peso fine five years ago. You can lose permanent residency status forever if you do not obtain an FMM temporary exit form when you leave and have it stamped upon your return.

That is a different issue. We are still required to obtain the FMM form when leaving, that part has not changed, just the 180 days out of the country in five years part.
