I have seen them in homes and businesses throughout Baja...so my guess is possessing and "antique" shell appears acceptable in Mexico.....fresh ones

As you cross the pedestrian entrance to the US thru Tecate, there's a display in a glass case for everyone to see with a sort of items that have been
confiscated and most certainly got the carriers of such items in a heap of trouble, and YES there are some turtle shell items and many other items
