TIJUANA, Mexico ? State agents arrested four Tijuana police officers in connection with the rape of an American tourist as she and her family were
walking back across the border into San Diego, authorities said Wednesday.
According to the victim's testimony, she, her husband and her young son crossed the border for the day on Oct. 7 and were on their way back into the
United States when they were stopped by four municipal police officers outside the Viva Tijuana shopping center, 55 yards (50 meters) from the San
Ysidro Port of Entry, said Diana Escalante, a spokeswoman for the attorney general's office in Baja California state, where Tijuana is located.
Two of the officers forced the father and son to walk to several nearby ATM machines and then robbed the money they withdrew. Another officer took the
wife to a Mexican police office located adjacent to San Ysidro's pedestrian crossing and raped her while the fourth officer stood guard outside,
according to the criminal complaint the family filed with Escalante's office.
The police later let the family go and the trio crossed the border before contacting U.S. authorities with their story. The husband and wife returned
to Tijuana in subsequent weeks and were able to identify the four suspects from pictures of local police officers, said Liza Davis, a spokeswoman for
the U.S. Consulate in Tijuana.
The rape victim and her family asked consulate officials not to release their names or their home state, Davis said.
"Extortion is common, but this is a much more serious crime and its not something that happens, or is at least reported to us very often here," Davis
said. "This is a positive case in some ways because of the response of Mexican authorities. We are really pleased at how the authorities on this side
of the border have responded."
Arrested Tuesday night were Officers Hector Manuel Arias, Victor Lopez and Jesus Ortiz. A fourth officer, Benjamin Rodriguez, was detained early
Wednesday, Escalante said.
Arias faces rape and abuse of power charges while Lopez and Ortiz have been charged with extortion and abuse of power. Rodriguez, the suspected
lookout, is being held on charges he failed to report a crime in progress.
"We've never had a case like this in recent years," Escalante said. "Police extortion is common among tourists, come on, but we've never had a rape.
This is a surprising and graphic case."
The officers were suspended from duty upon their arrests and were being held at the attorney general's Tijuana headquarters, where investigators took
their depositions Wednesday, Escalante said.
Lopez, Ortiz and Rodriguez were expected to be freed on bail, but a judge refused to set bond for Arias, the suspect facing rape charges, and ordered
him to remain behind bars indefinitely.

and then I opened the post and went "What the...!!!! Can you believe they let two of the creeps out on bond? Like forcibly extorting money from
someone's ATM card is somehow, less criminal. It was part of a whole package of violence toward this family and they should all be hung out to dry!

This is really sad and almost too much to believe. I would like to know more on exactly where this happened and how they could get away with it at the
time it was committed.
I really commend those people for going back and pressing charges after such a horrendous violation on so many levels.
I walked back across the border only once about 11 years ago. It was in January about 6:00 pm so it was dark. I was alone.
I don't know what the route is like today, but back then there were these two stairwells that take you to the pedestrian bridge over the river. There
were no lights and a sea of people moving up & down the stairs in total darkness. It was terrifiying. I have not walked across the border since.

Try and imagine the law enforcement climate that would enable these people to even contemplate doing such things, and you will be close to
understanding just exactly where your basic civil rights stand when you are in Mexico. Go, have fun, but do it with the understanding that you are in

I have walked across plenty of times in the last 5 years. My girlfriend and I (and she is blonde) go there to eat tacos have a "few" Pacificos, and do
a little shopping on Revolucion. We have never had a problem. This is such a sad and unfortunate happening. I really feel bad for the whole family! I
really hope that Tijuana authorities will take the proper steps to bring these "policeman" to justice. It really sickens me because I really have
enjoyed going to TJ for the day and now I may think twice about going there and spending my money. The ironic part about this is I am going to Bajamar
on Monday to golf. My friend that is going with me has never been across the border. I hope that he does not see this news. We were going to walk
across the border and go into TJ on Sunday afternoon. Now I don't know. Should we learn to stay "home"?

This news is VERY SAD....very very sad God bless to the victims.
We saw it on the news, I tried to NOT pay attention.... hearing the news, really...really hit me straight to the heart.
This incident put a negative impact on us, we enjoy mexico and shop, eat tacos there sometimes, we live approx. 35 min. from the border. We BRING
money to them' we help them, tourisms bring income to them etc... now I'am thinking twice on going there, I look at mexico police officers' different,
I don't think we can TRUST them anymore, I know not all are bad, but its hard to believe... why are things so corrupted nowadays....I hope they create a new law to some extent to punish criminals there.
Those poor family are scarred for life!!!
Someone's gotta do something about this, this CANNOT go without a HUGE battle!!!

What is most disturbing to me, is that this happened to a group of three: a husband and wife, with their child. You would probably assume you were

public condemnation can get way more done than any gun carrying. If you have the energy to write to a message board, have the energy to write a note
condemning the release of these crooks to these officials. If enough people threaten to keep their dollars on the U.S. side of the border (and
follow through on that threat), this kind of thing will change very quickly. Sometimes it's all about the money. I'll get a letter out today. -

That was indeed a terrible incident. It was reported in the San Diego Union-Tribune this morning. When one sends a letter, should it be signed
"Anonymous" or would it be more effective if one used his name?

Today's SD Union Trib article. Note that they used her buying prescription drugs without a Mexican prescription as the initial reason for the
"shakedown" setup.
As a matter of fact, I can think of an entirely appropriate punishment for this particular sex offender; I believe that in this case, the eye for an
eye sort of thing might apply.

Debra, I am a firm believer that the punishment be disproportionate to the crime. There would be no more jaywalking if the punishment would be
amputation of the right leg at the kneecap. For rape how about your wife and children sold into sexual slavery. Think that would be a deterrent? The
only criminals left would be true sociopaths. My only requirement would be that the penalties be widely publicized beforehand. That way no one could
whine about it.

I think punishing innocent wives and children for the crimes of the father might be getting a little too Klingon for my tastes. And Dave, there is a
flaw in your logic concerning brutal punishment for lesser crimes. For instance, in medieval England virtually all crimes were punishable by death.
What ended up happening was that criminals ceased to differentiate between severities of crimes. If a person was committing property crimes, perhaps
due to the lack of any other means of obtaining these things, and the pending punishment is certain death if this person is caught, why not he commit
a few murders and rapes? What does he have to lose?
If my son was working in a 7 Eleven, I would want any potential robber to have to think very hard before allowing his crime spree to escalate to
murder and hurt my son.

Jesse, You are absoluly right. I travel all over Mexico and Latin America and I am convinced that this is an isolated incident and the Police that are
involved will be brought to justice. As much as we talk about how corrupt the police are here in Mexico things will never change, not in my lifetime.
This has been going on ever since Cortez stepped foot in Mexico. Corruption is here to stay not only here in Mexico but all over the world. Alot of
people look at this terrible crime and say " Ill never go back to Mexico" however if you remember a few years ago there was a California Highway
Patrolman who raped and killed a woman he had pulled over in San Diego and I dont hear anyone saying " I wont go back to California". The problem is
that the police in Mexico are undertrained and underpaid. There is no "Internal Affairs" department in the PD office in Mexican cities that overlook
all aspects of police misconduct and there shoud be. I believe in Guadalajara several years ago they tried to promote a IA office and several officers
from that division were murdered as well. These officers need to made examples of and their punishment should be harsh however the Penal Code book in
Mexico gives specific prison terms for each offense and these punishments are followed to the tee and they are not that bad as far as time to be
served. This should be changed immediatly and the penaltys need to be more severe. None of these officers should have been released but you have to
remember where you are. Money to the right person will get you what you want---PERIOD-- and there is nothing you can do about it. I am a gringo and
have lived in Baja for 17 years and I have never been hasseled by the police. I tell them when I am pulled over for a violation that I am a retired
