Clamming? Legal or not??

We heard various versions of this.
Does anyone know the real story?
Is it legal, with a valid license, to take clams, and/or oysters?

(Obviously this is for information purposes only.....
no one in our crowd would dig the sand for shell fish)

Only legal for Mexicans to take shell fish.

And why wouldn't you dig the sand for shell fish, it is a great tradition.

There is no "story". As CaboRon already stated correctly: it is illegal for Gringos.
Clams, Lobsters any shellfish. Illegal.
IMPORTANT: Turtles are even illegal for Mexicans to catch.
Although offered everywhere, don't let you get cought to buy one.
Jail time for you and the seller.

I'm asking a legitimate question. This is (supposedly) a board where people who share a love for Baja share information and comraderie. I've never claimed to know all the Mexican laws, and I doubt you do either. Why would I know that? I don't even go clamming, but if presented the opportunity I would have.

You are coming to Baja for at least 10 years, maybe 20 or 30 ??
And you wanna tell us that you never talked with anybody about clamming?
That you didn't know/learn in 20 or so years what others learn in just one summer, that is rude (But in a different way.)

Not to enlarge upon this emerging catfight,
but I have been a regular in Baja since 1971 and have just discovered this year that there was an "issue" concerning clamming.

And yeah, rude responses don't need to find a home here.

(since I started the thread I guess I am entitled to chime in)

But it's ok to buy clams, oysters, and shrimp right? Also not ok to buy lobster, correct? Heading down to San Quintin friday to look for the shrimp farm.

Now that is an interesting question... I have been comming to Baja since the early fiftys and didn't know it was illegal to buy lobster.... I buy them all the time....does anyone have the definitive answer to the lobster issue .... I, of course know we can't take them from the water.

yes it is illegal to take shellfish BUT, i have allways been told that if it is for your own consumption and you do not transport(like to the states) that they will look the otherway. we have never had a problem with the law and a few times have provided clams to the feds that were camping nearby. i think it allso depends on the area your at and the type of clam. i think they have more of a problem pismo clams then they do say chocolates.:cool:

For gringos, taking clams is illegal.

But it is customarily allowed, in small quantities for personal consumption.

In the fast-growing Loreto area, procedures and enforcement of laws are evolving, perhaps in other areas as well. So customs can change.

Therefore, it's not a bad idea to ask from time to time what is allowed.

Regs change all the time as do local customs...here in our neck of the desert nobody can take the nice big yummy pismo clams...Juan is a fisherman with the coop and he can't even get em legally...hands off. But they wash up on the beach in a big swell and you can pick them up then.

With regards to clamming, the small manila looking clams seem to be ok, with the military. Last Dec. I was clamming with my Pops (79 yrs. young) in El Socorro. My Pops says to me there's some soldiers walking towards us. I told him to quit fooling around, he said no joke look. I look towards the beach, and sure enough 5 soldiers all carrying autos. walking to us. With my limited spanish I ask them if I was doing anything wrong. They just wanted to warn us about the tsunami warning that week, now it gets good. They ask to see what we were doing, and I showed them them the clams. 3 of them start turning over rocks looking, so I said used my small hand weeding tool I use. Now I've 3 soldiers clamming with us while the other 2 were holding the weapons. Es Mexico man....love it here. I wish I had a camera.

Lobsters, my buddy Greg was going thru the military check point before Ensenada, when they saw that he had lobsters in the cooler. His spainsh is excellent, but it took him a little over an hour to talk himself out of the situation. Got off with a don't do it again, and they let him keep the lobsters.

Pismos I believe same as lobsters, but I've brought them to the states, cleaned in kilo zip bags when purchase them. No problem with the check point.

I know a few spots on Mag bay whre ,at low tide, the clams are so plentyful and right on the surface, that you can fill, with 2 people, a 44 quart cooler in about half an hour. Manillas and butterclams.
Always struck me funny that the Mexican people don't show any interest in them as a food staple. Except maybe for the chocolates, which in my book are among the most undesirable, Usually tough and stringy. But, maybe, the guys that dive for them ,here in Loreto, only sell them to restaurants, to be consumed by gringos.:biggrin:

Although I've never had to, I've always been ready to say that I bought those Clams off of a Mexican vendor who came by.

I NEVER break any rules on either side of the border and ALWAYS tell the truth.

Opps...sorry, Cabo Ron...will do.

Find about 6-8 washed-up chocolates per person. Slice them in half...carefully slipping your blade between the halves. Scrape out the siphon and discard (black stuff).

Then, cut around the shell to loosen all the meat from shell...leave half in each open half-shell.

Add to each half: chopped onions, tomatoes, a squeeze of lime, a drop of tobasco, and shake liberal Parmesan cheese over the top.

(Note: You will see the 'foot' of the chocolate curl and an try to attack you when squeezing the lime juice on..this is a sign of a nice fresh 'washed-up-clam'. When swallowing this foot will try to grab your tonsils and hold on, but just swallow real hard and it releases.)

Grill on hot grate until cheese melts...let cool while opening a cold Pacifico ...and let eat right from the shell. Absolutely delicious.

And better than Viagra...so JT says.

If somebody comes to Baja as a Pinchy Gringo (so to speak in JR language) living in a Gringo enclave and is not willing to learn anything about Mexico, then, of course, the facts are certainly considered rude.

Now this is interesting. The reference to JR (who I am sure is watching all of this with great amusement from that great discussion board in the sky) and the "Gringo enclave" mean one of two things. Either TP is a blast from the Amigos past, or he's been doing some research. Inquiring minds want to know (and, I suspect, they'll find out).

My old fat buddy and I are going on an 18 day trip to BCS in May as soon as his shoulder heals up from the Docs blade

All he talks about is how good the choalates (sp) are

By the way my buddy is the brother of the guy who had the lobster problem in Loreto a couple months back...yep he comes from a poaching background

Tip:
Estuary entrance south of BoLA.
Fill a bucket for dinner with all the butter clams you need in 10 minutes.
Strictly from a subsistance point of view of course :(
