Illegal eviction in Puertecitos

So I see you are one of the owners of the Cowpatty....which is nearby, and you probable get all of the daily scoop as I used to when I owned a bar. How did you get this story? A friend? Word of mouth?

I find this story a little off. "No credentials were presented". Was it the local town cops involved?

Conflicting statement:
*The were never given an opportunity to appear in court.
*Puertecitos is in the Ensenada Municipal and these leases are in litigation with that jurisdiction.

Sorry....I'll reserve judgment on this. I find it to be a one sided story.

Gave buying in Mexico a lot of thought, a lot. Looked at plenty of places etc. There was always a little something that didn't seem quite right. Plus, I couldn't afford any of 'em at the time.:lol:

No judgement expected...just an open dialogue to make everyone aware that these things can and do happen.

I have been "Cowpatty" for over 30 years. I helped Richard start the bar but he owns and runs it......It's a namesake...this is not idle bar talk

Please note, local police were involved. The "judge", and two others did not present any identification or proof of who they were. Of course the police uniforms were self explanatory.

I am the source of the story, I was there.

These are Americans with current Rentistas. Yes there is another Mexican owner of the land.

The lease in litigation has been ongoing in Ensenada and pending. This eviction was processed thru the Mexicali municipal which does not have jurisdiction in Puertecitos. More than one way to skin a cat so they say.

Even though this is a "third world" country, I believe Mexico is trying to do better. If no one says or does anything it will never change. Just like paying the officer rather than going to the police station...

Renters were served in accordance with Mexican Law , and court appearances were made by any one concerned. The people in question have not accepted the legal landowners new lease and have refused to pay any increase in rents. They were served about 3-4 years ago, along with approximately 8-9 other renters who are the leaders of "the homeowners association.".
This situation has been going on for many years (over 6) and is creating many hardships for the remaining property renters.
As I understand it, the non payor was removed in accordance with a court order.

I attended the original lease negotiations and the original lease was OFFERED TO ALL tenants-- the association basically told the property owners to "shove it". Approximately 2/3's of the tenants chose to accept the new lease.

What does your greed have to do with it ?

They formed an association of renters?
They told the owner to shove the rent increase?
They did not pay the rent to the owner?
They payed the court?
Does the court own the land?
Do the renters have special rights not to pay correct rent?
The owner does not want to rent to them any longer?

Sorry Kat.....the bar is not mine, nor losing customers or booze money. I have been Cowpatty for many years before Richard built his bar.

I am not upset.....I just want everyone to be aware that these things can and do happen here. In this case it was never about the rent increase. And there are two sides to this story with valid issues on each side.

Even in Mexico their are processes in place to settle these types of disputes. Unfortunately, just as in the USA, these processes aren't always followed according to the law. There are many other facets of this situation that the court is reviewing.

No beer can I don't think the truth is funny. I found it funny that you thought I might have something to gain or lose from any of this. Marvin's place is certainly not a thing of value or beauty and the view of fish camp is certainly nothing to aspire to. I have an opinion that is different than yours. It is not about being mad.

Mscowpatty is (and has been for many years) in Baja.

Cowpatty bar is located at km 72 on the San Felipe Puertecitos road. Richard's Cowpatty bar is alive and prospering. Nothing to do with Puertecitos drama...just a nice place to hang out. I am not an owner. I retired from all that stuff in the states and here a long time ago.

Perhaps you should reread my posts--nowhere did I either mention your gain or loss, or attack you personally.

The failure of the association members to pay a proper and fair amount of rents has created bad feelings and divided neighbor against neighbor. It has also diminished the values of all our properties and has caused the property owners to delay or not complete needed improvements.

Mucho money $$$$$$ has been wasted on lawyer fees and court costs that could have been used to improve Puertecitos !!! It is unfortunate for all us "Mericans that the collective wisdom & knowledge of the associations "leaders" could fit in a thimble. American property laws do not apply here in Mexico.
When I first bought a "house" here in Puertecitos in 1981 along with partners George and Mike, we all agreed not in invest more in Baja then we could afford to walk away from.
I have almost moved beyond that point and all three of us have substantial investments in both time and $$$$$$$$.

As I stated, I have been involved in this lease process and have learned much about the Mexican property laws and its court system. I am also no dummy when it comes to property in the USA. I have owned, bought and sold many millions of property and have been involved in several condo/ property owners associations.

The lease I have and the rents that I pay are FAIR & PROPER !

If you and the others are so unhappy , why don't you all leave and start you own camp ???? Marvins place must not be too bad or else you wouldn't be here ?

seems part of the problem is the Mexican legal process taking six years which is one gov't changeover too many for an honest decision to be made. As long as political appointees run the paperwork jobs for the municipalities, it will always be a problem.

Hey Beercan- I quote you often on the "never invest more in Baja than you can afford to walk away from". Too bad everything invested here can't be measured in dollars or cents.

Setting aside the landlord issues...which most vacationers really dont give a rats ass about.....

Puertecitos is a good place now for camping...great boat launch..."pit" stop for gas/drink.....and a beer at the Cow Patty which isn't opened on Mondays.

I first came to Pueretecitos when I was 9 years old in 1959. In instantly fell in love with it and came back many times. My father ("Charlie") spent many years there and slowly improved the house until it is as it stands now, a three bedroom stone house on the beach on the north side of the bay.

He has gone to his greater fishing ground now, but I "own" the house and "lease" the property from the Orozco family.

When they asked for a new lease I had it translated and read through it. I was concerned about a few things in it so I asked for a rewrite of the lease and the Orozco family gave me one that fit my needs and dealt with my concerns. I found them to be easy to negotiate with and I gladly signed the lease.

I now make sure to pay my fee every January.

I live in Vermont so I do not get to come down as often as I like, but I do get to spend 5-6 weeks in May-June each year, which I hope will be expanding soon. When I retire I will spend a good 4-6 months a year there.

My main concerns are security and abandoned properties. About five years ago my place was broken in to but since then thing have been pretty secure. The abandoned properties look nasty and give the place a favella look. I wish these could be torn down and replaced by NOTHING, but they will probably be replaced (in many cases) with new buildings. That would be fine as well.

I just wanted to tell my story. I signed the lease and it worked out fine.

Charlie and I were very good friends here. He understood that problems existed with Clara. Obviously this is not a forum to express both sides without predjudice. Sorry if bad stories aren't acceptable. No matter what the legal instances are it is not acceptable to respond by throwing a 30 year residen'ts belongings in the dirt to settle a $7000 debt.

You just did more damage to Puertecitos reputation that Clara and her family! ................This what the landlord claims is due for back rent. Again, there is pending litigation in Ensenada. The property owners offered to pay the money up front and wait for the Ensenada court judgement.

......................Their are receipts for all the rents paid since the "negotiation" of contract went to the Ensenada courts. The $7000 "debt" is part of the case that has not been decided in Ensenada.

.........This is not about me. I am sharing what happened to a tenant, who bought and payed for their home years ago. They pursued the land lease contract through the court system and the decision is still pending. They offered to put the money up for the "alleged debt" as claimed by the landlord and cited in their personal lawsuit against them until a Judge can make a ruling in the case.

No matter what the legal instances are it is not acceptable to respond by throwing a 30 year resident's belongings in the dirt to settle a $7000 debt.

................This what the landlord claims is due for back rent. Again, there is pending litigation in Ensenada. The property owners offered to pay the money up front and wait for the Ensenada court judgement.

.........This is not about me. I am sharing what happened to a tenant, who bought and payed for their home years ago. They pursued the land lease contract through the court system and the decision is still pending. They offered to put the money up for the "alleged debt" as claimed by the landlord and cited in their personal lawsuit against them until a Judge can make a ruling in the case.

The rent down there is somewhere around 2500 per year. The tenant owed for 3 years?! Didnt pay a dime. No good well payments?

You just did more damage to Puertecitos reputation that Clara and her family! I have been lurking on this site for quite some time, it is time to speak. I have known Cowpatty for about 20 years and she is the real thing and so is Beercan. My first flight to Baja was in 1979 and i stopped going in 2003. For burros like Mcfez they should keep their mouths shut unless they can come up with there own facts and not what they interpet on this board. I feel better now. Flame on!

Years ago I had a customer( Ken Bondy) who went to PSF all the time and introduced me to Baja. Most of my trips where to PSF or Puerticitos. We bought a motorhome in 2004 and made it all the way to Cabo and starting using it more than the other RV. I am based at Hawthorne and just fly in the States now. With all the action in Mexico the wife is iffy on going down again. Really do miss the place.

Things are going good, yes I saw the report about Jim a great guy.
I am still flying but using the motorhome more & more. The wife is retiring in Feb. and we are going to do a 2 month trip around the west. Thanks again about the cement for my patio, We used a colored cement and had it stamped. I did a bit more than you said with the rebar and feel sorry for anybody that decides to remove it.

Wrong. Read my postings again. My facts came straight from the owner of the camp and tenants of that camp, not from information of others posting on this website. I was there a month ago. My statements were backed up by following postings of others (beercan and a few others).

There were obvious conflicting statements made (in her own words) from Patti Krall .

Krafty,
The coloring is done when still in the truck, after it is poured they do the usual skreeting. After it has dried for about 1 hour they use rubber patterns made from the real thing. Depending on what you want , as in our case they put on a darker shade of color and then laid the mould on and used a stamper to creat the pattern. With two colors it gave it a patena look. People that see it ask how may weekends it took to lay all those rocks. The actual stamping on mine took 45 minutes for a 20x40 patio. This process can not be done with a finished floor.

Dug out my Old Puertecitos file and reread all three leases. Starting with the original lease from Raphael in the '80's , then the "new lease" from 1992, and the "new new " lease from 2004.


If I can read it, the "others" should be able to read too.b]All three leases read the same in the last paragraph. Any and all disputes will be settled in Mexicali Court !

The Orozcos have family in Mexicali and it is closer and more convenient for the them . This started before my time and apparently carried forward with each lease.

If (and they probably did) the association members signed the "old leases" , they agreed to that clause. As I have found, the Mexican legal system is very different than ours here in the USA.
If there had been a problem, why would the Ensenada Cops enforce a Mexicali court order if it wasn't valid ???

I'm still learning .
