Just read this in the Sudcaliforniano news about this fellow known as Mano Negra is taking over more properties by installing "his people" in the
houses of 3 americans...sounds like he got guys from CREAD to do his dirty work...this is very distressing...appears that beaches Perlita, Perla,
Armenta have been fenced. It will be interesting to see if locals try to get in there during semana santa.
I gather that those involved Ted & cheryl Clinite, Terry & Carol Murphy and Alex & Gayleen Speros know about this but just wanted to
mention it in case they dont!!!!!! |
Here's a Google translation of that story:

Gustavo Alonso Alvarez
La Paz, Baja California Sur .- Rafael Muñoz Martínez "El Mano Negra," continues to expand its territory on the shores of Mulegé or complaints to the
Public Ministry, or brought before the invasion by PROFEPA Area Federal lawsuits or agricultural worth, this land is now seized of three houses in the
Bay of Santa Inés, the three owned by Americans, because the complainants did not know which agency to go.
This newspaper has been following for years of abuse that began in San Buena Aventura, when Rafael Muñoz with fake diplomas, according to the ANC,
deprived of a property and a building (a hotel) Olivia Higuera, La Purisima and ejidatario dealership the Federal Zone, is now reported more abuse and
few answers, despite the many complaints that have been brought before authorities of the three administrations at different levels and triennia.
Here are the transcript of the letter recently sent Olivia and Mark Higuera Burbey her husband, his lawyer Hector Essaú, where there are tired of so
much impunity and reported more offal.
"Mr. Hector Essaú: I received the letter to submit to a judge in the TUA, but I wish to mention that Munoz has not taken possession of the houses,
either rented or accommodate their" people ", these are to: Ted & Cheryl, Terry & Carol Murphy, and the Alex & Gayle Spero. This is
regardless of the roadblocks to the shop and set up wire fences on both sides of the hotel which resulted in the burning of the houses to a side of
the hotel. I also want to communicate that on March 25 attended a reunion in the delegation of the measures to take the different agencies (Red Cross,
the Navy, the soldiers, Public Security, Civil Defense, command, delegation etc. ,) during Holy Week, we had the opportunity to expose what is
happening in Buenaventura, La Perlita, La Perla and Armenta to date continue fenced and visitors will have access to the beaches, this made the day
Today Thursday, through the delegate did Mulegé knowledge to the presidency in Santa Rosalia, sending 3 people of the City Council responsible for
ZOFEMAT to verify whether these beaches nearby. I accompanied the check fences installed in the shop and both sides of the hotel, leaving Rafael Muñoz
to take photographs and credentials, Muñoz was bufando, could not speak, this comment I did ZOFEMAT of Santa Rosalia, when went to his vehicle and
continue to take pictures of the Other beaches, Munoz stressed that would remain in his vehicle and it was.
We suggested that the group of those affected to talk to the mayor soon.
Following is the translation of what Marco has to say about it:
I know that another building has been taken by Muñoz, the home of Ted and Cheryl Clinite, at the moment is occupied by people CREAD (Rehabilitation
Center) and also Alex and Gayle Terry & Carol Murphy, using these people with barbed wire fencing our property we have under contract with the
Ejido La Purisima, where were near the back of my home workshop and carrying machetes and bars. The only authority that the area was inspected PROFEPA
thereafter no outside, that's why Munoz was going to seize more construction. As you may have to grant you knowledge of the ZFMT and the obligation to
pay the use and exploitation, however Muñoz continues to claim for camping on the beach for more than 4 years, robándonos to date more than $
100000.00 pesos per year, including caravans. If I walk outside the hotel, Muñoz sale immediately in a threatening manner to scream that I remove his
property, I have made 2 previous reports against him without presenting the medical report that nothing has been done and while Muñoz used for all
pressure . ¿Rafael Muñoz Martínez is immune to being appropriate?
We call you by phone to the ejido of Mr. Luis Fernando González Cereco tel. 612-14-022-69, 128-68-19 office in La Paz, what ejido being done about it
and told me that in this case he had no warrant to intervene. Maybe you can tell me because we have to defend ejido land without any support from the
ejido. Olivia is very stressful as I did. It is embarrassing that people ask us if our case was resolved as well as some officials who come to the
restaurant and was resolved or if the state is a situation that obviously in place to improve seems to be getting worse. Urges the court to act.
In March 2008 we said that the judge would give his decision regarding the houses, said in julio/2008 later, in March 2009 and is still no resolution,
and if it is not far from reversing early Muñoz destroy everything as it has been doing.
Muñoz has such a bad reputation and that the authorities must exercise TUA against this person, because they are supposed to defend the rights of
farmers, because according to our Constitution, justice must be expedited. No?
We prefer to be in communication with you via e-mail because it is sometimes impossible to make phone calls, in addition to written communication. Is
this OK?
We believe that the prosecution has been corrupt, the judge found us innocent, and to date remain steadfast (in mayo/2009 are 4 years), never before
has someone been in this situation.
We are unable to leave or exit Mulegé therefore fear that Munoz and his employees do something in our absence, we expect good news soon, Olivia and I
want to go to La Paz and trying to get something positive, note that we are living a desperate situation My neighbor is my worst enemy, we help you
and your and you're in constant communication with us. It has been 7 years living this nightmare.
P.D. What happened to the conclusions of the expert sent by the judge?
Marco Burbey Higuera and Olivia. "

Does "El Mano Negra" own Hotel Buenaventura? Our plan was to overnight there in June on our way south. We may need to make other plans.

Hey, Frank,
I stayed at the Hotel San Buenaventura a year ago. It was very scenic, but serene it was not. Lots of truck exhaust noise in the night from the down
hill and uphill grades behind the hotel. Also there is no electricity between 8 p.m. and 8 a.m.

Please, will somebody driving the Baja highway with bolt cutters in the vehicle stop & cut the fences this a**hole shyster put up across the
beach roads???
While you're at it, use the cutters on his big cajones!!!
I wish I had done it while we were down there.
Did you know that he had the police put Olivia in jail overnight, using his forged documents. What a trauma that was for her! She was crying when she
told us the story.
Everyone PLEASE boycott Hotel Buenaventura in the future. Force Munoz out of business!!!This jerk has got to be stopped before he lays claim to the
whole of Bahia Concepcion.
However, DO support Mark & Olivia next door (if they can last).

I first heard about this guy when my wife and I were at the bar at the old La Fonda in 2002 0r 2003 and he was sitting there with a friend and struck
up a conversation with us. When our table was ready we said bueno suerte and he handed me his card an said he owned a hotel on Bahia Concepcion and
one in TJ and if we presented his card we could get a free night's stay. Some months later I found his card and looked up his website and saw the link
to his plans for Requeson. As I recall he was looking for investor's and you could get in on the ground floor for a million US or something. I do seem
to recall that he had one hand that was slightly deformed? But it was La Fonda and I was drinking tequila! I have to look in my Baja archive file and
see if I still have that card.

If you click on the links tab on the bottom left and then click again on munoz-industries you get to a page that talks in badly translated verbiage
about the grand plan. This guy is certainly persistent if he is still trying to 'capture' paradise.

Not good! Cread? Those dudes are all over the Mulege area, major intersections, Pemex stations, they're panhandlers. Guess they've taken it to another
level.

Cread is sorta like a work release/ drug recovery outfit. They're good folks on an individual basis, but looks like the head honcho isn't. They have enough feet on the ground to creat serious problems for various land
owners, or "Thought maybe I owned the land." owners.

This is all news to us. We own one of the homes in this discussion, and there are two american couples living there right now in two other homes and
they have not reported this to us. I will contact them and see just what the story is. I don't always believe everything I read in the paper.
This legal case between the restaurant owners and Sr. Munoz has been going on for some years.
