It's really not a clearance but a postponement till the next time they "need" to enforce whatever environmental violation they can invent to garner
the next peso (ala 1000's of dollars) from a gringo.
Profepa, is the eco- police of Mex, well known in certain expat communities. Punta Chivato is one of them. Not talked about much- accept by those that
feel confident enough they'll never be targeted again.
For a number of years they have been randomly running around chivato and elsewhere , showing up and handing out violations . Many, that have the
wherewithal , just pay the imposed "fine" and make it harder for others to "negotiate" a more reasonable punishment .
Though not held accountable , the Ejidotarios went in and bladed off hundreds of acres , filled in arroyos and flattened an other wise large , low
drainage area. That is now known as shell beach.
There is no rhyme no reason as to who is selected for violation , like a lotto you may get selected or you might not and wonder why your neighbor
did..

an enviormental report is REQUIRED on all building
if you build and don't have one you are at risk of fines
so in this case red bear HAS an enviormental report
and a letter of clearance from the government
this protects future buyers form HUGE fines
because the seller did the RIGHT things
if you have a house and no enviormental report
and clearance letter then
"prepare for punishment"
it's just a matter of time...

Sorry to butt in. However.... the way it worked with PROFEPA here was they did such a bad job of trying to screw us that for most of the properties
that they fined a judge in Mexico City declared that any infractions were illegally pursued and threw out the cases against us and are not allowed to
be brought up again. Most have never gotten the environmental study that the ejido should have gotten to start with. However if you do further
improvements my understanding is you'll need the environmental study and permits. That is what I'm trying to do now. I don't know what Redbear has
done so I'll leave that up to her to answer. I like their house and the price is at the going rate for a property like theirs in Punta Chivato today.
During the boom it would have been almost double. At the cost of construction here today you couldn't build the house for what they are asking. And
it's on a double lot.

The parcel owner of this property is one of the good guys and went to bat clearing the PROFPA mess up. He was also the one to start development on
Shell Beach. Good neighbors, roads & water system. There have been 4 resales in the last year on his parcel. So people have confidence to buy now.
And the prices are low, for Chivato.

No, not wrong, just not complete. By gringos , I imply anyone that obviously has bling on the beach .
You are correct that a permit is NOW required. However , most on shell beach were never made aware of any environmental requirement when they bought
or before they built. That is changing. Most homeowners were horrified and blindsided when Profepa suddenly showed up and randomly handed out
infractions. Most of any environmental "damage" was done long before the buyers came.
Yes , evidently redbear has a clearance letter NOW, as do many others. I think there were near a few cardiacos on the beach to get to that point.
Years ago, when you went through the permit process, environmental was NOT part of it. That has changed and is NOW integral.
As represented by RnR's question , "What is a PROFEPA clearance", it is clear many are unaware nor are made aware that there are important and costly
hoops to jump through when investing in Mex.
Also, as Russ alludes , the parcel owner where redbears' property is , is without a doubt the most conscientious and stand up guy in chivato..
unfortunately, he is the exception to the norm.

The road from Palo Verde to the Chivato turn off is pretty rocky and the grader just pops up the rocks that have been packed down. It just makes it
worse. But after the Punta Chivato turn off it's being dragged twice a week and is usually a 45 to 50mph road in a car. Trucks & trailers beware.
Be aware of the larger holes at that speed they HURT. Best months? IMHO May & June before the summer heat. But the water can still be cool then.
Best is October & November when the summer season changes and the water is still warm. The kids are back in school and the snowbirds are just
getting ready to invade for the winter. September 15th is the traditional change change date for the heat but many times it doesn't change until late
October.

Thanks for posting the pics Russ. I've been having problems downloading them from my little laptop. We miss Chivato too. We were at the property in
November and everything looked great. Also, just to clarify for all that have replied: I have a Profepa clearance from a judge in La Paz, but had to
hire a lawyer and gather tons of documention to prove that grading occurred before I owned the property. ISince I do environmental work in the US, I
was fully versed about what was needed to prove my case. I also hold valid building permits for the house; a rarity in Baja. Not all people know that
they need a permit to build the house as well. My property is priced to sell and as you can see from the photos it's even more beautiful in person.

I remember camping here in 1996. Don't remember any homes. Was I high or was I a mile or two up the beach? I do remember some type of restaurant on
the point.

By '96 there were a few homes on Shell Beach and Most of Punta Chivato was already developed.
