Taking a vehicle that does not belong to me?


Here is the deal, when my wife and I divorced we swapped around some vehichle titles. We share a Dodge Ram 1500 4WD truck, technically it is registered in her name. Since we both have the same last name I'm thinking this would not be a problem, but I have to ask. I am only going to San Felipe if that matters. I also have a Chevy Astro AWD van registered to me I could take but I think I'd rather take the truck.

That correct course would be to have a NOTARIZED LETTER from her giving you permission to use it, include the dates or from this day forward, etc..

In reality, I don't see there being a problem... as long as the Mexican insurance policy for that vehicle has YOU as the driver.

Nobody but us know you two are divorced, afterall!:cool:

Insure your drivers license. When you return to the states and US customs asks if it's your vehicle, just say yes. [communal property] No sense opening a can of worms with the full story.

Having the same last name practically insures you that you will not be hassled. As for the insurance, I seem to recall that even if you insure the vehicle in the registered owner's name, any permissive user is covered. Before we got married, we used to take my then girlfriend's vehicle to Baja. I recall insuring it online, using her registration. and I don't recall ever having to identify myself as the driver, even though I virtually did all the driving.

Depending on how the vehicle is registered you may not have any problem at all. If the vehicle is registered to you OR your ex-wife then you can do anything you want with it.

If it is registered to you AND your wife (no "or") then you could have a problem. In this case you should have a notarized letter from your ex giving you specific permission.

This is why it is always best to record ownership with the "or" between you names---------you never know what the future holds.

At least that is my take-----------Lawyers, please correct me if I have goofed.

i say, "don't worry about it"....sheesh, in twenty plus years i have never, and i mean NEVER had any papers that needed to be presented...a couple decades, folks....i think i would roll the dice..let's not complicate things here...i mean really.
