We would really appreciate hearing the outcome. Unfortunately we were totally unaware of this until your posting and we have two fideocomisos. Our US accountant is looking into this for us. He was unaware of the need to file and we are based in San Diego where there are many people with second residences in Baja. I can't imagine how an accountant in Montana (or where ever your friend is from) would know about this.

It's over.

My friend prevailed with the help of Amy Jetel, a lawyer in Austin, Texas (512-370-2750). It costs $$$$ to get it done, but in the end, Amy took it to the National IRS office. The National IRS Office told the local IRS agent to stop. Thanks to the information provided by Baja Nomad, John68, he was able to help my friend find the right person to take on the IRS in his case. My friend has spoken highly of Amy and said she is a real pro. It's only a ruling in his case, so others may still find that “rouge IRS agent" that will want to screw you if you haven't filed the forms.

Case closed.

I'm going to go have a well deserved Margarita.

Yay, great news anyone else being audited for the same thing can file an IRS form stating they will abide by the decision of another equal case-naming the case.

Wonder when your friend will get an apology from the overly aggressive agent! hah!
