No passport for 4 year old.Will there be problems??


Hello Nomads,
During the first week of April my husband and I will be travelling to Baja (by car) with our son, his wife, their 1 year old son and my daughter-in-laws 4 year old son from a previous relationship. I wanted to do things right so I took everyone down to get them passport cards. Problem is that the father of the 4 year old is playing power games and refused to sign a letter giving permission for the Passport Card. My daughter-in-law provided papers showing she has physical custody and wrote an explaination that the father is not part of the child's life, has been in jail on domestic assault charges and that she has a restraining order against him. However, the child's passport card was denied. I don't want to leave him home to miss the vacation with his parents (our son has been his "dad" since he was 18 months old)...We will be reentering the US at Mexicali. Will there be any problems with his not having a passport or passport card? Any suggestions? Anyone have experience with this?? Thanks for the help.

Nope, no problem. All you need is a birth certificate. Our kids (2 and 4) cross multiple times per year. Now technically the kids are supposed to have FMT from Mexico. But we have asked many times about getting them for our kids. The immigration guys in Mexico generally agree that we can wait until our kids get older.

Besides the birth certificate my daughter took my grand kids down to there local DMV and had state Ids done for all of them.
Smooth sailing with those Id's added with the birth certificate

I've been through this same thing. I ended up having to get a court order for my ex to sign for the passport. The judge also agreed to order that I had permission to travel out of the country without his consent. Your daughter in law might have to look into that.

More info that she will need to know: "In order to prevent international child abductions, Mexican law requires that minors traveling without their parents, or with only one parent, present proof that they have their parents' authorization for travel. They should carry a notarized letter from the absent parent or parents authorizing travel into Mexico. The minor must be carrying the original letter as well as proof of the parent/child relationship, usually a birth certificate.

There are a few exceptions to this rule:

In the case that only one parent's name appears on the birth certificate, that parent's authorization is sufficient, along with presentation of the birth certificate.

If one parent has sole custody of the child, a court order must be presented."

I wish her luck, I know it's a hard battle.
