Really Marla, you think this is more than a civil discussion of Mexican land title, Ejido and land trespass/possession issues? I don't. I think it has been fairly tame. Maybe you meant the posting of a photo on Facebook of Mark's "new house" he just took from someone who built and paid for it. Yes Marla, that's the real baja spirit. I don't think so. I am interested in the Mexican land law issues, especially when it applies to fellow Nomads. I am in a land dispute myself and have been learning about the law. Raphael has posted and published the land title SRA file number for the parcel of land in PB. He's put his head on the chopping block by calling out everyone in BCS government in the press. If he's not legally correct- they will surely let him know in a hurry.

Of course all the scandalous details (aside from the legal points) are Nomad fodder. Newbies popping up and former residents chiming in to trash both sides. I do have to admit I find the plot and players telenovela worthy.

The reason this thread is heading south is there is no more factual information and people are still thinking someone involved was in the right.

So... what's with guy getting whacked in the head with a machete and tossed in the ocean to die? Did he threaten to give up the famous PB Turtle Soup recipe? Def. telenovela worthy.

I don't find it trashing, but instead sharing more information that I think is pertinent.

If you like the information Munoz has shared with you I have 5 years of emails that I could share with you. I find it all very interesting and informative, but most people can't put there lives on hold for 10 years and still not have an outcome.

The point being for me is this is the same story I have been hearing since 2002. Olivia was going to jail and would be off the beach next week, and paradise would be restored.

If that information isn’t worth adding to the conversation I don’t know what is!

This is public information.
There has been published responses to Munoz. La Procuraduría General de Justicia del Estado responded to this case, interestingly he cites the Magna Carta (natural law) in his explanation and states that this case will not be tried in the media but instead through the legal process required by those legal entities required to manage this process.

He stated that olivia has previously presented legal copies of ownership of three buildings on the site and has been and was in possession at the time of the alleged delinquent actions - Aggravated Dispossession, Aggravated Robbery and Threats committed against them by MARIO PEREZ ALAN RIVERA AND MARY ELIZABETH ESPINOZA MONTAÑO.

"Como se comprometió la actual administración, desde el mes de Abril del 2011 la impartición de Justicia se brinda para proteger las garantías consagradas en la Carta Magna y el Código Penal y Procedimientos Penales en el Estado sin distinción alguna, dando certeza jurídica a las propiedades e inversiones en el Estado."

Does this article say that Olivia had legal ownership of 3 homes at the time that Rafael's goons arrived ?

I've seen many of Rafael's claims in various places; mostly things he has written or news accounts to which he has obviously fed information.
I have seen some of the same from Mark and Olivia.

I have seen no evidence that a trial has given either of them satisfaction.
Has there been a final legal decision on any of this ?

The article states, in the words of the Procuador, olivia demonstrated legal certified copies of legal agraria ownership previously in 2011 which were accepted by the court and was and is in possession and therefore the alleged offenses by those aggressors are being pursued through normal processes at the local and state level.

At this time the Federal Police are in BCS in large numbers of special tactical forces in Santa Rosalia, Cabo, La Paz etc... conducting large scale actions, there is some uncertainty as to what they are doing with large helicopters, full size planes, it's in the news everywhere. I have observed them in my own neighborhood simply conducting residential traffic calming and of course pursuing race cars on city streets. They seemed o have arrived with Hilary Clinton but she left and they stayed.

If the Federal police would like to intervene in Munoz case they have the opportunity.
