Think 53 "posted" he won his case, but I don't believe he post an "image" of the said document

He did post "images" of title and a number of others... related this issue

Ownership of said "site"

Don't know if they are still up ... ya would have to go back through the "whole" Turtle Tread...

That's even too much for me, at this time ... :lol::lol::lol:

When I met and talked to Nomads on Bahia Concepcion, then met Mark and Olivia... I had no doubt who was good and who was bad in THIS dispute. Perhaps there were bad things done to renters in the past, but that is seperate from their defence of Rafael/ Muñoz's attacks.

Lots to say, but I can't until later.

This is part of a letter from a relative. I would like to share...

I have been so worried about you and Olivia. That Munos (sp) is such a crazy person. It’s hard to deal with such crazy, unreasonable people. Especially with all those goons he sends your way. They are so bad and obviously out of their minds on dope or something. I thought it was against the law to have a gun in Mexico or is it that the criminals can carry the guns and people like you and me cannot protect ourselves and property. Such is life I guess. I pray each night that the two of you will be ok and that God will keep an eye on you and protect you. You all have worked so hard for so many years. You deserve better treatment for your kindness to other people . . . . people who needed help, people you’ve given gas to helping to get people to Mulege for medical attention. What are these people thinking about? I hope they go jail for a long long time for carrying guns, shooting at your customers, pointing a gun in your face. How horrible for those poor people from Canada and how horrible for our beautiful Baja to have these Canadians go home with this tale of terror. This ruins our tourism for years to come. Who would come back after being shot at. And after hearing about this people who have never been to beautiful Baja will never want to come no matter what. A real battle to fight. I hope the law stands firm on these criminals and show that they have a backbone and will NOT stand for this behavior. We have so many friends here that make the trip to see the whales each year and keep adding to the group each year. It makes me so proud to talk about the safety we feel about Baja. I don’t feel that way right now so I say nothing. If they ask me if I’m afraid living in Baja I just say, “I love living here”. But I wouldn’t encourage anyone to make the trip south until we feel it’s safe. And I know that will happen. The people of Baja need business in their restaurants and hotels. The government has to work hard to restore the reputation of Baja.

You are the broken record Diver. The legal info you question has already been posted. Stop asking the same questions over and over. Take the SRA file number (National land title file) and go look it up yourself.

Raphael has helped dozens of Nomads determine the legality of Mexican land titles. To the best of my knowledge the ONLY people complaining about his advice, legal help and expertise are involved in this case. I think that is a very important point you don't seem to acknowledge or care about.

In the beginning of this thread we agreed that both parties had conflicting judgments from different courts- agrarian and Federal. That doesn't not mean Raphael in not the legal owner.

Rafael says Mike George was flying in drugs and running a bordello at Buenaventura. If so I'm very disappointed in Mike and his marketing of said items. I was around him back in those days and all he ever tried to sell me was a burger and a beer.

--Seriously, this is my stand with respect to the documents provided by Rafael, which appear genuine.

I have no problem with someone protecting property with firearms. If one party pepper sprayed a second party who is armed, thank your lucky stars you were not killed. I would not suggest someone ever pepper spray an armed cop or security guard, because you will be shot and possibly killed. No cop or security guard will allow someone to disabled them so they can take their firearm and kill them with it. Just try it and see! It is a justifiable homicide.

The Mexican Constitution is the top law in Mexico as in the USA.
The Mexican Constitution article 27 say that all the land inside Mexico's borders is by origin National property and that private property has to come from it.
That mean, that originally all the land inside Mexico's borders was National Land and to come out of it, the nation has to issue a National title, and then it is private property.
My title was issued by the Federal Government, national land office and it came out of National Land and that mean it is Private Property.

One of the qualities of a National land Title is that is not effectable by agrarian actions and that mean that Ejidos cannot grab that land; the logic is that if the Nation sold that land, it would be illogical that the Government takes that land to create an ejido that is given to ejidatarios for free.

Estates cannot give away, take or do anything with National Land, any such action would by void by law, also they cannot grab land from a National Land title like mine.

One of the many requisites needed to issue a National land title is that all ejidos inside a 7 Km. radius, agree that they do not want that land and Ejido La Purisima did exactly that, signing and stamping its seal on the official document and that mean they agree that my land was not theirs or not even want it. in a unavoidable consequence, no ejido cantract can affect my property and if that is the case, Olivia’s contract is by force outside of my property limits and by force she is wrong.
