Lot for Sale - Alfonsina's


I own two lots at Alfonsina's and am selling one. It has a simple trailer and patio/deck. Lots are approximately 45 feet wide, right on the Sea of Cortez. Includes an aircraft tiedown behind the lot which allows you taxi right from the runway directly to your place on the beach. This is lot #57, approximately 2/3 down the beach from the cantina.

Ownership at Alfonsina's is simple: you get a yearly renewal on your rental of the spot from the family. There is no title to you for the property. Secure? Yes, in my opinion (I've been going there since 1973) and there's little likelihood of losing your lot unless you don't pay the rent (currently mas or menos $2600/year).

Anyone who know's Alfonsina's will tell you there isn't any place quite like it on the Baja.

Pictures to follow.

$25,000 plus a transfer fee to be paid to Alfonsina. She instituted this policy two years ago. No fees have been paid yet that I know of because lots just don't change hands frequently. Her rate was 20%; not sure about negotiability.

That's unreasonable and absurd. 20% for what? It's just free money, required for no other reason than she has the hammer. If she has become this greedy today, what can anyone look forward to tomorrow.
You would be best served, although bordering on unethical, if you didn't mention this extortion and paid it yourself.
It bothers me no end to hear of this type of blood-sucking going on here.

So the asking price is $30,000. Add in the $2,600 annual rent and the asking price for the first year is $32,600 or a bit more than $2,700 per month.

A 10 year, (I know 9 year, 364 day) lease, properly recorded, would make it easier to swallow. I wonder why there is a one year limit to the lease.

I'd ask the property owner what the services are that I'm getting for this fee, just to see him squirm. :spingrin:

The property owner, with this mysterious and substantial fee, has made it more difficult for all the current lease holders to sell "their" humble abodes.

$25k for a trailer and 1-year lease? The lease has little value if it secures property for only 1 year. The market price for a lease that expires in less than 1 year is zip. Is that trailer mobile?

And a transfer fee of $5K on a 1-yr lease at rate of $2,600/year? Sounds like first year lease payment on a 1-yr lease is $7,600, and you value trailer at $25k

I think you should vacate lease and sell trailer for $25K

My objection is to the $5000 dollar transfer fee. That's outrageous. Was that made clear when the original contract was put together?

A lot at Alfonsina's commands more $$ probably because it is one of the nicest beaches in Baja that one can live or vacation on.

Another thing...What lease? It's no more than a rental agreement. Was the tenant legal in Mexico when signing the agreement? If not, it's even more meaningless. Try taking a rental agreement to court in your defense.

David K's point about "location, location, location" is a good one and Goat's parsing of the costs is better than mine.

Dennis, if the rental agreement is recorded with a Notario, wouldn't it stand up in court if there was a dispute.

The answer to that question is probably, "maybe." I say that because it appears that equal application of the law in Mexico is still a distant goal.

I've never heard of a rental agreement being recorded. For that matter, I've heard of very few leases being recorded. It's more myth than fact.
These beach-camp landlords stay away from all that legality since they don't want to relinquish control. Why should they? They've been operating with nothing more than a hand shake since way before the lease and fideicomiso were ever in the mix.
It would be an unwise event if a foreigner ever implied that he trusted the government over the word and honor of the landlord. Not a good way to win friends and influence people.

if you have the jack and it makes you happy - do it!!:biggrin::biggrin:

if yur worried about a biz loss.....yur in the wrong game.

pay your money if to you it's worth it. and be able to walk anytime it becomes goes to caca.

Alfi's is one of the best fly in beaches in baja. if i could swing a place i would in a heart beat. life is short - enjoy any paradise you can find.

It ain't the money. If the fee wasn't agreed upon by both partys in advance of the subsequent sale, it's extortion. No twenty percent, no sale.
Is that part of the Baja Mystique one should be prepared for, Mike? No way. It's like being told as you leave Disneyland that you have to pay to get out the door.

dennis, on second thought i recommend that when you submit your offer, make it a condition that the seller pay the transfer fee. problem solved.
