New La Paz scam alert
Yesterday a cousin visiting from Italy was driving a Grand Cherokee and while turning from Abasolo to Encinas to fill the gas tank a young guy
deliberately jumped over the car getting hit by the left mirror.
The "jumper" immediately called help on the cell phone. Transito Police, an ambulance and an "uncle"(in scam) arrived.
The transito police tried immediately to be on the side of the "car jumper" bringing due suspicion that they were in agreement with him.
I do not want to mention all the details of the ordeal but my cousin ended up 7 hours in Ministerio Publico jail (6 people in 4 M2) where finally at
10 pm got released thanks to local contacts and smart lawyer friends that we immediately moved.
I ended up paying the guy 3,000 Pesos to drop all charges present and future. Money was obviously nothing compared to his big theatre and probably
what he was trying to pursue with probable future false medical tests.
Apparently it is pretty common in Mexico City and big towns but never heard it in Baja.
Here below is an email (Spanish only) that I received about one month ago regarding this practise being pretty common in Mexico.
MONTAJE DE ACCIDENTES
Existe una nueva 'industria del accidente', muy bien organizada que se dedica a montar accidentes de tránsito a conductores(as) de vehículos
particulares y empresariales. Por lo general estas bandas operan en lo que el tránsito ha llamado 'corredor del accidente', principalmente en las
zonas en que hay empresas multifuncionales y personas pudientes que pueden pagar altas demandas.
¿COMO FUNCIONA?
La modalidad funciona así: Estas bandas escogen muy bien a sus víctimas o sea los conductores(as) ya sea por el carro, empresa, etc. y se le 'tiran'
encima al carro para simular un accidente.
Son personas que a diario juegan con su vida, pero debido al nuevo código penal, una demanda de este tipo por parte del peatón herido puede llegar
hasta el monto de $ 408.000 lo cual hace muy lucrativa esta actividad.
Son un grupo de profesionales confabulados en esto: la persona que simula el accidente, los testigos, peritos en medicina legal y, desafortunadamente,
algunos policías de tránsito.
De 10 accidentes diarios que ocurren en estas zonas 8 SON MONTAJES. Por lo general uno mismo termina involucrándose por no saber cómo actuar en una
situación de estas...
Y es lógico, debido a que por nerviosos, se olvida hasta el teléfono de la casa.
COMO ACTUAR EN CASO DEL ACCIDENTE
Si uno atropella a un peatón y este muere hay que esperar a que el policía de tránsito llegue a levantar el croquis; pero a veces dichos croquis son
modificados para inculpar.
Si ud cree que el croquis no corresponde con la escena original, aunque le parezca extraño, NO SE NIEGUE A FIRMARLO, pues ante su negativa, un testigo
(por lo general miembro de la banda) firma el croquis, el cual no se podrá cambiar después.
Lo correcto es: FIRMARLO y en la parte que dice OBSERVACIONES escribir que usted no está de acuerdo, que el croquis esta cambiado, etc. No le pida
permiso ni le diga al agente de tránsito que usted va a escribir en Observaciones, pues él lo puede intimidar con cosas como irrespeto a la autoridad
etc. Ese espacio es para su uso, así que hágalo sin decirle nada a él, es su derecho.
Si tiene la posibilidad de tomar fotos, hágalo! UTILICE LA CÁMARA DE SU CELULAR
Si el peatón queda herido, lo ideal es esperar a que llegue una ambulancia, pero uno debe hacer un juicio y valorar el estado de la persona, porque si
la persona muere mientras la ambulancia llega, usted va a ser inculpado(a) por no prestar ayuda. De manera que si usted cree que la persona necesita
ayuda inmediata y la ambulancia no llega, usted debe llevarla a la clínica más cercana.
Si en este caso la persona llegare a morir en su automóvil, no se detenga en ningún CAI o estación de policía, pues usted puede ser inculpado(a) por
homicidio y el cuerpo de la persona se constituye en prueba.
Usted debe seguir hasta el hospital o clínica y allí los médicos determinarán que la persona murió en un accidente de tránsito o aún mejor, podría
llegar con vida. A su vez, al hospital llegará un policía de tránsito que en ese momento se convierte en Policía Judicial (ya que él recoge todas las
pruebas y testimonios que va a entregar a un fiscal) y le pedirá a usted, el conductor(a), una versión libre de lo sucedido.
POR NINGUNA RAZÓN DIGA: QUE LE DIÓ, LO ATROPELLÓ, LO COGIÓ, etc., porque usando esa terminología usted estaría aceptando la culpa y dándole la razón a
los que lo quieren estafar. Diga que usted iba por la vía 'x' a velocidad 'x' y la Persona se atravesó y se presentó un ACCIDENTE .
El policía de tránsito le va a preguntar con qué parte del carro golpeó al peatón, no caiga en su trampa, diga que la persona se atravesó y ella fue
quien golpeó el carro en la parte de adelante....NO responda que UD LO GOLPEO CON 'X' PARTE, porque esta aceptando la responsabilidad.
El próximo paso es que a usted lo lleven a Medicina Legal y le hagan 2 pruebas que son muy diferentes: prueba de embriaguez y prueba de sangre.
La de embriaguez es en la que lo ponen a caminar el línea recta, mirar fijamente un dedo, etc. Si usted da negativo(a) en esta prueba NO deje que le
hagan la prueba de sangre, usted no está obligado y esta última puede salir positiva así usted este sobrio. Esto debido a que el alcohol permanece por
algunos días en la sangre. Así que si usted ha bebido licor en los días anteriores la prueba puede salir positiva así usted esté en sus cabales. Pero
si la prueba de embriaguez da positiva usted no se puede oponer a la de sangre, pues es para confirmar.
En este caso NO ACEPTE jeringas que no sean abiertas delante de usted. De aquí usted será llevado a una URI de la fiscalía, y será detenido por 72
horas y su carro será llevado a Los Patios. Si usted sospecha que está siendo víctima de un montaje dígalo, pida que se investigue, contacte a un
abogado PENALISTA; no deje que estos delincuentes se salgan con la suya.
Por lo general estas personas demandan a los 8 - 10 días del accidente y cuando se presentan demandas tan rápido... sospeche!!, el 90% de ellas son
arregladas, y oscilan entre los valores de $80 a $390 millones, amparados bajo dictámenes por Peritos de Medicina legal que son cómplices y dicen que
la persona tiene incapacidad de 9 o 10 meses cuando en realidad la incapacidad es de 20 días y el tiempo de incapacidad es determinante para que el
juez dicte el precio que hay que pagar. Uno puede pedir un segundo aval de otro perito si tiene sospechas y salvar de esta manera su patrimonio.
Si un segundo perito difiere enormemente del primero, éste último quedará al descubierto y pagará con cárcel y perderá su tarjeta profesional y se
descubrirá que usted ha sido víctima de un montaje.
No se trata de pensar que los verdaderos accidentes no ocurren, pero es mejor estar informados de todo esto ya que la estadística es grande. Así que,
por favor, tomemos precauciones y cuidémonos.
Háganse asesorar de su seguro y recuerde no caer en el juego de palabras que pueden terminar inculpándolo así usted no tenga la culpa.

This is the first time I go to jail and that something like this happens to me. It has been a good experience to get information to add to my
sociological investigation here in La Paz. Now I have something to write and to tell in my report that is not just an information reported by
newspaper.
Despite the gravity of the situation we had some good laugh. The bed quality of the cellar was something incredible. It seemed to be in a movie but it
was pure reality. It is a matter of human rights not just of criminality.
I have realized the situation of the public order presents some problems which need to be tackle by the authorities as soon as possible. The main
problem is not only the presence of criminal organizations but the system that permit to them to act freely. In some cases the system favorite the
business of the criminal activity.

That was a friend that was robbed by the police. Two of the police that were involved had been fired a few months later.

Aldo, what do you think made your cousin a mark? Was the Jeep a rental car or foreign plates? Was he/she alone in the car (so no other witness),
what time of day? Anything you suggest to watch for so this does not happen again?

The car was pretty old, dirty and with Mexican plates. My cousin Alex had his windows rolled down and they could have spot him while he was waiting
the incoming traffic to pass before turning from Abasolo to Encinas.
His appearance is more German than Italian. That could have given a hint that he was a foreigner to prey on.
