Thank You Susan, We met w/ Manuel Barajas today. The news is painful. for a 825 m2 lot, 1500 sq foot house, 500 sq foot garage. close to 10,000usd.incls his fee. No one in our small developement thinks the environmental is required. They all think we are nuts and that the requirement is only for beach front and resort or marine park land (cabo pulmo). We are 12 km south of pulmo. I guess when thay came to cabo pulmo in 2006, they never went south of there. Even the developer, La rebiera building dept and the local delegado says we don't need one. Manuel said they are mistaken. If anyone has a comment on any of this, Great.

Greta, if I were you, I'd ask all those "officals" (developer, La Ribera building department & the local delgado) if they are so positive that an EIS is NOT required, to put it in writing on their official business or agency letterhead, over their signature & then you take those letters to SEMERNAP in La Paz & get a truly official answer/determination from the agency who is responsible. Or take them to PROFECO & get a legal determination from Manuel Barajas, since he's with the violation enforcement agency. I'm betting NONE of them will be willing to put it in writing.

My current construction is not "beach front, resort or marine park", and I was legally required to get one, despite the fact that I only has 2 things which fall under environmentally protected growing on my property. Three SEMERNAP employees said my property didn't need an EIS, upon request of my builder, they wrote a letter to that effect & presented it to the only authorized signature authority at SEMERNAP...their boss...and he refused to sign it & countermanded their determination...I got the EIS.

Edit: SEMERNAP and/or PROFECO should have their feet held to the fire to make sure all the outlying offices are notified of current laws & make them accountable when they intentionally mislead property owners!!:fire::fire:
