Howard hit the key issue. The plea bargain was for a specific period, and if the judge did not agree, then the defense was going to go to trial. It is the job of the defense lawyer to tear apart the testimony of that 13-year old on the stand, make her relive it detail by detail, challenge every thing she said. It would not be pretty, and the prosecution had to weigh whether she would fold up on the stand and they would lose the entire case. That would set him free.

I don't think the decision they made to plea bargain was done lightly.

Actually comitan's castration solution makes sense to me. Perhaps not physical castration - just require him to show up monthly somewhere to take the hormone shot that drops his testerone level to 0 and that should do it.

My other thought was that I thought they now have implants that sex offenders are required to have that allow them to be monitored 24 hours a day. I don't know how cost effective such a monitoring system is.

Both of these suggestions are less expensive than paying for the costs of this man's life sentence.

Then there's the straightforward solution - death. But you need soemthing before it gets to that stage. By then there's a string of murders already.

I agree with Diane - it's not a political issue or solution.

As a young woman myself I can only begin to imagine the horrors that this girl went through and I pray that I never have to go through anything like it, or any other girls or boys for that matter. It's a shame that such people exist and have such twisted minds as to take the gift of life so lightly and be willing to take that gift from someone. It rips my heart open to even think of what the parents must be going through. I am not one to support violence but in these cases it enrages me that such lively human beings are being deprived of years and years of love and happiness just because of a few scum bags have their minds so twisted that they don't seem to understand such things as love, family, friends, respect, faith, etc. or maybe they do, in their own twisted crazy sort of way...My prayers go out to Chelsea's spirit that will go on living in each of us for ever.

From the mouths of babes! I have 4 sisters and eight nieces. I pray none of them ever have to deal with rape or murder. If they do, I would hunt down and kill the animal like the rabid vermin he is. Then smile as I went to jail. I truly hope her family can get through this, they will never get over it. God bless her soul, and send the bastard that did this straight to hell!

I think castration would be a great thing to do to rapists. I think the sex gets them into the trouble in the first place, and then they freak out and kill them thinking they'll get away with it. Crazy bastards don't deserve to live in society anyways... they obviously aren't mentally fit for it.

There is a Statuate on th CA books that allows for chemical castration of sex offenders at the judges descretion but I don't think it has ever been used. Besides, rape is more about commiting violence then penile insertion so castration may not really reduce these crimes.:mad::mad:

OK. I admit that I have not researched the earlier case. And I also feel the palpable anger and frustration being voiced by the posters on this thread. But, as everyone trashes our legal/ judicial system, I was just wondering if the plea bargain may have been influenced by significant input by the victim and her parents. Having to testify in such matters as victim can be emotionally devastating. It's one thing to submit that the DA made the decision on the plea for their own reasons, but, if there had been forceful input from the victim and her parents, I'd have to lighten up on the DA.

and yes I agree that is a possibility, that they did not want to put the 13 year old thru a trial...that is what is wrong in these cases,, they should not go thru a trail,, they are only children. this happens to many times,, we need to change how this is handled in the legal system,,
